63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on January 6, 2021 and concluded on January 11, 2021. The director was contacted by telephone to initiate the inspection. There were 52 children present and 14 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records, 3 staff records and the background checks for 5 persons submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-C-1-B
Description: Based on record review and staff interviews, the licensee did not ensure any agent had obtained a sworn statement, search of central registry, and criminal history record check within the required timeframe.

Evidence; Two out of five agents records were review and two were determined to have inadequate Virginia background checks.
1) The record for agent #2 start date 9-21-20, did not include a sworn statement prior to start date, sworn statement was dated 1-4-21. The criminal record was dated 1-6-21 and was not obtained prior to start. The search of the central registry dated 1-7-21 was not obtained by the end of the 30th start date.
2) The record for agent #3 start date 9-21-20, did not include a sworn statement prior to start date, sworn statement was dated 1-6-21. The criminal record was dated 1-6-21 and was not obtained prior to start. The search of the central registry dated 1-7-21 was not obtained by the end of the 30th start date.

Plan of Correction: Moving forward WCCC will apply the same onboarding procedures to obtain background checks for agents as it does for staff. Upon an agents nomination, they will be provided with a sworn statement to complete and will be required to begin the background check process to ensure all checks for the agent are completed within the required timelines.

Standard #: 63.2(17)-1721.1-B-4
Description: Based on record review and staff interviews, the licensee did not ensure any agent for a child day center obtained a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence; Two out of five agents records were review and two were determined to have inadequate out of state background checks.
1) The record for agent #2 start date 9-21-20, did not include results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry for the state of South Dakota where they had lived within the last 5 years.

2) The record for agent #3 start date 9-21-20, did not include results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry for the state of Alabama where they had lived within the last 5 years.

Plan of Correction: Using the above process, sworn statements from agents will be used to determine if additional out of state background checks are required. For any state that an induvial has lived in within the past five years, we will utilize the Interstate Child Care Background Check Contact list to complete the out of state child abuse and neglect registry, criminal history, and sex offender registry checks for the agent. The Interstate Child Care Background Checks Contact list will be reviewed to ensure the most current version is being used. It will be documented if any of these checks are unable to be obtained due to the induvial state laws regarding the release of information.
Process has begun with the states of South Dakota and Alabama. Requesting that information be returned within 30 days due to varying turn around times.
