Technical Assistance:
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Documentation of progress on obtaining the out of state background checks and/or the results of these background checks must be sent to the licensing inspector within 10 days of the inspection.

Comments:
A monitoring inspection was initiated on 1/19/2021 and concluded on 1/22/2021. The director was contacted by telephone to initiate the inspection. There were 58 children present and 10 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 5 children?s records and 5 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of records, the licensee did not ensure that every staff who has resided outside of Virginia in the past 5 years has the results of an out of State Child Abuse and Neglect Search for those states where they resided by the end of their 30th Day of Employment or service,

Evidence:
Five staff records were reviewed.
The records for staff #1, staff #2 and staff #3 contained Sworn Disclosure Statements that indicated they lived out of state within the past five years (Staff #1 Hired 9/2/2020 - CA, Staff #2 Hired 10/1/2020 -TX, Staff #3 Hired 12/7/2020 - TX), but did not contain results of a central registry search for those states.
The record for staff #2 and staff #3 did contain copies of the out of state requests,but the results of those requests had not been obtained.

Plan of Correction: The director will contact the appropriate agencies to request that the results for staff #1, #2 and #3 be sent immediately. Documentation of the contact to include when the call was made, who spoke to her and what they said will be placed in the staff records. Continued follow up each 30 days until results are obtained.
