63.2(17) License & Registration Procedures

Technical Assistance:
Discussed out-of-state background checks requirements.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 02/01/2021 and concluded on 02/10/2021. The facility representative was contacted by telephone to initiate the inspection. There were 19 children present and 4 staff. The inspector emailed the facility representative a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 2 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-160-A
Description: Based on record review, the center did not ensure that staff members submit documentation of a negative tuberculosis screening. Documentation of the screening shall be submitted no later than 21 days after employment.
Evidence:
1) The record for staff #2 (start date 01/04/2021) did not contain documentation of a tuberculosis screening.

Plan of Correction: Staff #2 is scheduled for screening on 02/15/2021.

Standard #: 22VAC40-185-60-A
Description: Based on record review, children's records did not contain all required information.
Evidence:
1) The record for Child #1 did not contain an address for an additional designated person to call in an emergency if a parent cannot be reached.

Plan of Correction: We will contact the parents to provide the information.

Standard #: 22VAC40-191-60-B
Description: Based on record review, the center did not ensure that an employee not be employed or provide volunteer service until the agency has the person's completed sworn statement or affirmation.
Evidence:
1) The Sworn Statement in the record for Staff #2 was dated 02/10/2021. Staff #2 began employment on 01/04/2021.

Plan of Correction: The Sworn Statement was given to the employee for the second time to have it filled out and signed immediately after inspection was conducted.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center did not ensure that staff members had Criminal History Records Check (fingerprints) prior to theirs first day of employment.
Evidence:
1) The finger printing results in the record for Staff #2 were dated 01/25/2021. Staff #2 began employment on 01/04/2021.

Plan of Correction: I (Nancy Lobo) will make sure every new hire has finger printing and all background checks necessary before starting work.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, it was determined that the center did not ensure that employees that had lived out of the state of VA within the last 5 years have in their files the result of an out-of-state Sex Offender Registry search request by 12/31/2020.
Evidence:
1) The record for Staff #2 (start date 09/03/2009) did not contain documentation of an out-of-state Central Registry search request. Staff #2 had declared in their sworn statement having lived out of the state of VA within the last 5 years before employment.

Plan of Correction: We did mail out an out of state sex offender form to North Carolina, but we do not have proof of postdated envelope or anything in return from North Carolina. We mailed out a second one on the same day inspection was conducted.
