Technical Assistance:
The Inspector provided written documents:
*2020 legislative implementation with emphasis on new out-of-state background check requirements effective July 1, 2020.

Comments:
This inspection was conducted by licensing staff using an alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 02/11/2021 and concluded on 02/18/2021. The director was contacted by telephone to initiate the inspection. There were 81 children present and 15 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 4 staff records and 4 children's records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

The licensing inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years. The results shall be obtained prior to the first day of employment.

Evidence:
1. The results of a sex offender check from the State of Ohio were not obtained prior to employment for staff 1.
a. Staff 1 has a hire date of 12/11/2020 and the results of the sex offender check were obtained on 02/19/2021.
2. The results of a sex offender check from the State of Georgia were not obtained prior to employment for staff 2.
a. Staff 2 has a hire date of 01/06/2021 and the results of the sex offender check from the State of Georgia were obtained on 02/22/2021.
3. The results of a criminal record check from the State of Alabama were not available for staff 2.
a. Staff 2 has a hire date of 01/06/2021 and has resided in the State of Alabama within the past five years.

Plan of Correction: The criminal record check from the State of Alabama has been requested for staff 2.
Going forward, all out-of-state background checks will be obtained prior to employment for any staff who has resided in another state within the past five years.
