63.2(17) License & Registration Procedures

Technical Assistance:
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Consultation was given on the center needing to implenment a system to ensure the background checks for employees and volunteers are completed in a timely manner.
A corrective action plan to ensure timely background checks for staff and volunteers was submitted along with the plan of corrections. Updates include a new staff file coversheet, a new employee checklist, Director signing off on employee coversheet upon hiring, a monthly spreadsheet reviewed including both volunteers and employees to ensure all complete records are maintained and retraining office staff. (received from the center 3/3/2021)

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 02/18/2021 and concluded on 02/23/2021. The Director was contacted by email to initiate the inspection. There were fifty four children with twenty direct care staff which is within ratio for supervision. Reviewed a sample of staff, children and volunteer records, trainings and emergency preparation. Medication was on-site the day of the inspection. Lunch served today was cheese melts, tomato soup and fruit. The playground was not observed during this remote inspection. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

Description: Based on staff statement and observation, the center did not have a method to prevent use of outdated medication.
Evidence"
An emergency medication needed for Child #1 expired 1/2021 and had not been returned to parents.

Description: Based on staff statement, a working, battery operated radio was not available in the building used by children.
Evidence:
The center radio had fallen between a desk and the wall and was not accessible to use in case of an emergency.

Plan of Correction: An emergency radio was found in the office cupboard

Description: Based on staff statement, an evacuation drill was not practiced monthly.
Evidence:
The evacuation log was missing a drill for October 2020 and the Director confirmed that no evacuation drill was conducted that month.

Description: Based on staff statement, 2 of 3 new volunteer members have not completed a Sworn Disclosure Statement (SDS) within 30 days of volunteering.
Evidence:
Volunteer #1 and #2 assumed the Board positions on 9/1/2021 and did not have a completed SDS as of 2/23/2021.

Plan of Correction: SDS forms were completed 3/1/2021 and 2/24/2021

Standard #: 22VAC40-191-60-C-2
Description: Based on staff statement, 1 staff member and 2 volunteers do not have a search of the Virginia Central Registry search within 30 days of employment or volunteering.
Evidence:
1. Staff #1's date of hire is 11/2020 and did not have a central registry finding. The administration never sent it into VA DSS as reported on 2/24/2021.

2. Board Members #1 and #2 assumed the volunteer position 9/1/2020 and the center did not have a completed search on file as of 10/1/2020. The administration never sent it into VA DSS as reported on 2/24/2021.

Plan of Correction: CPS check forms were notarized and mailed 3/3/2021.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on staff statement, 2 of 3 new volunteer members have not submitted to fingerprinting within 30 days of assuming the Board position.
Evidence:
Board members #1 and #2 assumed the positions on 9/1/2021 and did not have a completed fingerprint letter as of 2/23/2021.

Plan of Correction: Fingerprint scheduled for board members.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on staff statement, an Out of State Child Abuse and Neglect Search (CPS) request was not on file for any state in which the employee has resided in the preceding five years.
Evidence:
Staff #1 was hired 11/2020 and no Out of State CPS search was on file within 30 days of employment.

Plan of Correction: CPS checks have been mailed.
