Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. An investigation was conducted for self-reported concerns received on August 18, 2020 regarding noncompliance with standards for behavior guidance and use of physical punishment. After a careful review of the facts based on interviews, and the viewing pertinent records and documentation, it was determined that the concerns were valid. A violation notice and plans for correction were completed and available as part of this inspection.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on a review of documentation, interviews with staff, and a record review for relevant staff and children, the center failed to ensure that the activities remained in compliance with center policies and procedures at all times. Evidence: During the morning of August 18, 2020, Child 1 bit child 2 while playing in the toddler area. Staff member 1 then bit child 1 through his clothing on the upper left arm. Staff member 2, 3 and 4 observed redness and a bruising bite mark on child 1's arm.

Plan of Correction: Staff member 1 is no longer employed at the center. The administrator reviewed the allowable methods of discipline at a staff meeting training and the types of punishment that are never allowable. Orientation training of new staff continues to include the discipline policy of acceptable and unacceptable methods of discipline and will be reviewed. The administrator and supervising teacher will oversee assistant staff who are handling behavior issues.
