63.2(17) License & Registration Procedures

Technical Assistance:
Reviewed background check requirements for employees and agents.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 03/24/2021 and concluded on 03/25/2021. The director was contacted by telephone to initiate the inspection. There were 22 children present and 6 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-60-A
Description: Based on record review, 1 of 3 children's records did not contain all required information.

Evidence:
1. The first date of attendance for Child #1 was 01/28/2021.
2. The record for Child #1 did not contain documentation of viewing proof of the child's identity and age.

Plan of Correction: I have requested it from the parents. I will talk with the parents again today.

Standard #: 22VAC40-185-550-D
Description: Based on record review and staff interview, the center did not complete a minimum of 2 shelter-in-place drills per year.

Evidence:
1. A shelter in place drill was documented on 11/24/2020. The emergency drill log did not contain documentation of a second required shelter in place drill for the year 2020.
2. Staff acknowledged a second shelter in place drill was not practiced in 2020.

Plan of Correction: Normally one drill is completed in the Spring and one in the Fall each year, but we were closed in the Spring. I will make sure 2 are completed each year.

Standard #: 63.2(17)-1720.1-A
Description: Based on record review, the center did not obtain the results of a search of the VA Central Registry every 5 years as required for 1 staff.

Evidence:
1. The most recent VA Central Registry check results obtained for Staff #2 (date of hire 01/04/2016) were dated 02/10/2016.

Plan of Correction: The center will provide documentation that the request was sent within 10 business days.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not obtain a copy of the results of a criminal history record check and a search of the sex offender registry from a state in which the employee has resided in the preceding five years for 1 staff.

Evidence:
1. Staff #1 (first date of employment 09/14/2018) has resided in the state of Rhode Island within the past 5 years. The results of a criminal history record check and sex offender registry check were not obtained from the state of Rhode Island for Staff #1.

Plan of Correction: The center will provide documentation that the out of state criminal history records check is completed within 10 business days. The sex offender registry check was completed on 03/25/2021.
