Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 2/17/2021 and concluded on 3/18/2021. Complaints were received by the department on 2/8/2021, 2/9/2021, 2/10/2021, and 2/16/2021 regarding allegations in the area of ratios and supervision of children. The director was contacted by telephone to conduct the investigation. The inspector reviewed 3 staff files and one child's file.
Based on video camera screen shots, record review, and staff interviews, the evidence gathered during the investigation did support the allegations of non-compliance with standards or law. Violations were documented on the violation notice issued to the facility.

Description: Based on interviews with staff and review of supervision policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's playground supervision policy states, "Always be aware of the number of children being supervised". The supervision policy states "Teachers should keep children within sight and sound at all times including bathrooms and nap times." On February 9, 2021, Child A (age 21 months) was out of sight and sound supervision, after being left alone on the playground when the class returned to the building.

Description: Based on staff interviews and video camera screen shots, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: At approximately 4:07 p.m. on February 9, 2021, Child A (age 21 months) was seen alone on the playground on the video camera system. The child was observed alone on the playground until 4:15 p.m. An anonymous person called the center to advise that a young child was on the playground alone. A few minutes later, a staff person was observed on the camera system bringing the child inside. The staff were not aware that this child was not with the group until she was returned to the classroom. The owner said there was confusion about whether the child should be with Class 200 or Class 250, so neither class realized she was missing.

Description: Based on staff interviews and video camera screen shots, the facility failed to have all children under 10 years of age within actual sight and sound supervision. Evidence: From 4:07 p.m. to 4:15 p.m. on February 9, 2021, Child A (age 21 months) was observed alone on the playground on the video camera system, out of sight and sound supervision of staff who had returned to the building. An anonymous phone call was made to the center to advise that a young child was outside alone. A few minutes later, a staff person was observed on camera bringing the child inside. The child was out of sight and sound supervision for a period of at least eight minutes.

Description: Based on review of video camera system screen shots and staff interview, the center did not maintain the required ratio of one staff member for every 5 children ages 16 months to two years old. Evidence:
1. On February 8, 2021, at approximately 8:20 a.m., there was one teacher with 7 toddlers (children ages 16 months to 2 years) in Room 200 (toddler room). A screenshot of the class at approximately 9:00 a.m. shows one staff with 8 toddlers. A screenshot of the class at 9:20 a.m. shows one staff with toddlers. The owner stated that several staff were absent on February 8, 2021 due to inclement weather and the rooms may have been out of ratio.
2. The owner stated that the facility has been out of ratio at other times due to staffing issues. Three staff have left the facility recently, sometimes without notice.
