Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A non-mandated monitoring inspection was conducted on March 23, 2021. A self-reported incident was received by the department on March 10, 2021 regarding allegations of supervision. The director was contacted by telephone to conduct the investigation. Five staff were interviewed, one child record reviewed, and the Employee Handbook was reviewed.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or laws and violations were issued. The violations can be found on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interviews and review of the center's policies and procedures, the licensee failed to follow their own policies and procedures when one child was left out of sight and sound supervision of a staff member.

Evidence:
1. In the Employee Handbook under the Interactions with Children section, it states, "Children must be within sight and sound supervision of staff at all times."
2. Staff #1, #2, and #3 confirmed the center's policy regarding sight and sound supervision of children.
3. On 03/09/2021 at approximately 5:00 p.m., Staff #1 and Staff #2 were in Classroom #1 with one child, Child #1 (age 10 months).
4. Staff #1 informed Staff #2 that she was leaving the classroom to go to the laundry room. Staff #1 left the classroom.
5. Staff #2 reported that she yelled out in the hallway that she needed to use the restroom. No other staff member heard her.
6. Staff # 2 reported that a parent of another child heard her yell and and offered to stand in the doorway of the classroom.
7. Staff #2 states that she put Child #1 in a crib and left the classroom to go to the restroom and locate another staff member.
8. Staff #3 reported that she saw Staff #2 at the entrance the restroom.
9. When Staff #1 returned from the laundry room, she was told by Staff #3 that Staff #2 had left Classroom #1 leaving Child #1 to be watched by a parent.
10. Staff #1 stated that when she got back to Classroom #1 she found Child #1 in a crib and a parent of another child standing in the doorway of the room. There was no staff person in the classroom with Child #1.
11. Child #1 was left unsupervised by a staff member for approximately two to three minutes.

Plan of Correction: The director has gone over proper procedures for when staff need to leave the classroom on March 10, 2021. A training will be included in the next meeting on April 29, 2021. Staff will get a copy of staff handbook and be requested to read and sign documentation by April 9, 2021. Staff members will be informed during a staff meeting of the disciplinary actions that could be taken either termination/or suspension if this standard is violated again.

Standard #: 22VAC40-185-340-A
Description: Based on interviews, the center failed to ensure the care and protection when a child was left out of sight and sound supervision of a staff member.


Evidence:
1. On 03/09/2021 at approximately 5:00 p.m., Staff #1 and Staff #2 were in Classroom #1 with one child, Child #1 (age 10 months).
2. Staff #1 informed Staff #2 that she was leaving the classroom to go to the laundry room. Staff #1 left the classroom.

Evidence:
