Effective July 1, 2020 SB 668 requires licensed child day centers to obtain a copy of the results of a criminal history name search and sex offender registry check from any state in which the individual has resided in the preceding five years. These checks are in addition to the previously required out-of-state central registry check.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 5/13/21 and concluded on 5/14/21. The director was contacted by telephone to initiate the inspection. There were 65 children present and 11 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed five children?s records and five staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for the violation cited and return to me by 5:00pm on Wednesday, May 19, 2021.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not obtain the results of a sex offender registry check from all states in which a staff member has resided within the last five years prior to employment. Evidence: Staff A, with a start date of 3/1/21, disclosed on their sworn disclosure that they had lived in Tennessee within the past five years but there are no results of a sex offender registry check on file from Tennessee for the staff member.

Plan of Correction: Employee A is a rehire. 2018 DCS result stated "No evidence was found indicating that the person listed above is substantiated as a perpetrator of child abuse or neglect in Tennessee". This individual did not return to Tennessee after the year 2018.

Virginia's criminal history background check conducted through FBI based on employee's fingerprint results was conducted on 2/24/21. The search "included a review of the sex offender registry to determine if the individual has registered as a convicted sex offender." Based on results of search, employee was eligible for rehire.

On 5/14/2021 Tennessee Sexual Offender Registry Search was used to update the information. "Search data not found." Sexual Offender registry through the State Police showed "No offenders found. The search criteria did not match any offender in our database" using information for employee A on date of hire. Employee A is not a sex offender according to all searches conducted.

Corrective Action: 5/14/21 Tennessee Sexual Offender Registry Search was conducted to update any possible new information. "Search data not found."
