Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review and interviews.

A monitoring inspection was initiated on 9/14/2021 and concluded on 9/15/2021. The director was contacted by telephone and a virtual inspection was conducted. There were 57 children present, ranging in ages from 2 years to 5 years, with 6 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 4 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-191-60-B
Description: Based on record review, the center did not ensure that all staff complete a Sworn Disclosure Statement prior to hire.

Evidence: Staff #2 (Date of Hire: 9/14/2020) had a signed Sworn Disclosure on file dated 9/22/2020. Staff #3 (Date of Hire: 8/30/2020) had a signed Sworn Disclosure on file dated 8/31/2020.

Plan of Correction: This is the pre-hire date. The legally Contracted date is Sept 8, 2020. Staff #2 was completed before school began. Staff #3 ? Over a year ago and director no longer with us. A pandemic year.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review, the center did not obtain the results of a central registry search within 30 days of employment for all staff.

Evidence: Staff #2 (Date of Hire: 9/14/2020) had central registry results on file obtained from another child care facility. Background checks are not transferable.

Plan of Correction: Over a year ago. Director no longer with us, but we would advise her that the background check became Invalid when teacher changed schools.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center did not ensure that each staff submit to a fingerprint-based national criminal history background check prior to hire.

Evidence: Staff #2 (Date of Hire: 9/14/2020) had fingerprinting results on file obtained from another child care facility. Background checks are not transferable.

Plan of Correction: Over a year ago. Director no longer with us, but we would advise her that the 5 year valid background check became Invalid when teacher changed schools.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not obtain sex offender registry search results prior to hire or request the results of an out of state central registry search by the 30th day of employment for staff who have resided outside the state of Virginia within the last 5 years.

Evidence: Staff #3 (Date of Hire: 8/30/2020) indicated on a signed Sworn Disclosure Statement dated 8/31/2020 that they have resided in Georgia within the last 5 years. There was no documentation of a Georgia central registry search request or the results of a Georgia sex offender registry search.

Plan of Correction: When we learned of the new law instituted during Pandemic shut down summer, we were surprise that Licensing did not give us a courtesy Update upon opening. We forwarded the information we obtained from Georgia to licensing in fall 2020 receiving no negative comment. This staff member has resided in VA for the past 5 years.
