Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program. A monitoring inspection was initiated and concluded on 09/27/2021. The director was contacted by telephone and a virtual inspection was conducted. There were 107 children present, ranging in ages from birth to 5 years, with 16 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:

Standard #:	22VAC40-185-350-E-1
Description:	Based on observation and interviews with administration it was determined that the facility failed to maintain a ratio of one staff to 4 children ages birth to 16 months. Evidence: One staff member was observed caring for five children in the older infant room with ages ranging from 12 months - 16 months. Based on the attendance record and staff interview it was determined that the classroom was not in ratio from approximately 10:30 am - 11:00 am.
Plan of Correction:	Four staff members were out on this specific day. Administration has hired 2 new staff since this inspection.
Standard #:	22VAC40-185-350-E-2
Description:	Based on observation and interviews with administration it was determined that the facility failed to maintain a ratio of one staff to 5 children ages 16 months - 2 years. Evidence: Two staff members were observed caring for 12 children in the toddler room with ages ranging from 16 months - 2 years. Based on the attendance record and staff interview it was determined that the classroom was not in ratio from approximately 10:00 am - 11:00 am.
Plan of Correction:	Four staff members were out on this specific day. Administration has hired 2 new staff since this inspection.
Standard #:	22VAC40-191-60-C-2
Description:	Based on review of three staff records it was determined that staff were still permitted to work at the facility when documentation of a central registry check was not on file within the first 30 days of employment. Evidence: Staff A (start date: 11/06/2020), did not have documentation of a central registry check on file and were still permitted to work at the facility. This is a repeat violation, administration states the central registry check for staff A was obtained however, misplaced.
Plan of Correction:	A central registry check will be requested for Staff A. Staff A will not be permitted to work at the facility until it has been obtained.
Standard #:	63.2(17)-1720.1-B-4
Description:	Based on review of three staff records it was determined that administration failed to request out of state central registry checks, out of state criminal history checks, and out of state sex offender checks within the first thirty days of employment for staff indicating that they have lived outside of Virginia within the last five years. Evidence: Staff A (start date: 11/06/2020) who indicated living outside of Virginia within the last five years did not have documentation on file that an out of state central registry check, sex offender check, or criminal history check had been requested. This is a repeat violation.
Plan of Correction:	Administration will request out of state central registry, and sex offender checks in the state of previous residence within the last five years for Staff A.
