63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A renewal inspection was initiated on October 4, 2021 and concluded on October 12, 2021. The director was contacted by telephone and a virtual inspection was conducted. There were 63 children present, ranging in ages from 4 months to age 4, with 6 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 child records and 4 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-570-I
Description: Based on observation and staff interviews, the licensee did not ensure that a one-day's emergency supply of disposable bottles, nipples, and commercial formulas appropriate for the children in care shall be maintained at the center.

Evidence: Emergency bottles and formula were observed for infants the one infant did not have the required emergency formula.

Plan of Correction: Emergency formula will be prepared for the infant.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and staff interviews, the licensee did not obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry (CPS) or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence: The licensee did not obtain the required out of state background check for staff #5 for Florida where they had lived within the last 5 years. Staff #5 date of hire was 4-27-2021.
1) There were no results of a sex offender check available for review. The sex offender check is required prior to the first day of employment.
2) There were no results of a CPS check available for review. Staff #1 documented the check had been submitted but not followed up within the required time frame.

Plan of Correction: Staff #5 sex offender cam back today. No results. Staff #5 CPS check was done today w/ $25 dollar fee.
