Technical Assistance:

HB1823 adds ? 22.1-289.058 to the Code of Virginia. This bill requires all licensed child day programs and religiously exempt child day centers, certified preschools, family day system homes and certain other programs that serve preschool-age children operating in a building built before 2015 to be equipped with at least one carbon monoxide detector. The final regulation to amend Standards for Licensed Child Day Centers (22VAC40-185, now 8VAC20-780) to address federal health and safety requirements will become effective on October 13, 2021. Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, and an interview with staff. A monitoring inspection conducted on 9/16/2021 with an exit interview on 9/28/2021. The executive director was contacted by telephone and a virtual inspection was conducted. There were 68 children present, with ten staff supervising. The inspector reviewed compliance in the areas of administration, staff qualifications and training, and special care provisions and emergencies. A total of three child records and five staff records were reviewed. The information gathered during the inspection determined non-compliance with standards that are documented on the violation notice issued to the facility. Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office by 4:00pm on Monday, 10/4/21. Standard #:	22VAC40-185-160-A
Description:	Based on review of five staff records, the facility did not have documentation of a tuberculosis (TB) test/screening for staff within 21 days of hire. Evidence: the record for staff #3 (date of hire: 8/2019) did not have documentation of a clearance statement signed by a physician, the physician's designee or an official of the health department.

Description:	Based on review of documentation, the facility did not have written authorization from the child's parent for prescription drug use. Evidence: the record for child #2 did not contain a medication authorization form signed by the parent for emergency medication on site.

Description:	Based on review of five staff records, it was determined that not all staff had an Office of Background Investigations (OBI) fingerprinting-based criminal history record check prior to their first day of employment. Evidence: the records for staff #1 (date of hire: 8/30/21), staff #2 (date of hire: 9/13/2021) and staff #3 (date of hire: 8/2019) did not have an OBI determination letter.

Description:	Based on review of five staff records, it was determined that not all staff had an Out of State Sex Offender Registry Search or Out of State Criminal History Name Check prior to their first day of employment. Evidence: the record for staff #2 (date of hire: 9/13/2021), who indicated they have resided outside of Virginia in the preceding five years, did not have an Out of State Sex Offender Registry Search or Out of State Criminal History Name Check determination letter.
