Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program A monitoring inspection was initiated on 12/7/21 and concluded on 12/9/21. The provider was contacted by telephone to initiate the inspection. There were 14 children present and 2 staff present. The inspector emailed the director/provider a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on a review of 3 staff records, it was determined that the provider did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing).

Evidence:
1. The record for staff #2 working during the inspection, did not contain documentation of a completed national criminal history record check (finger printing).
2. Staff #1 reviewed the record for the staff #2, and confirmed that all of the results of the finger print background check (finger printing) were not available for viewing during the inspection.

Plan of Correction: The provider responded: Staff #2 has previously completed the request for the national criminal record check (fingerprint), but we were unable to find during the inspection. If the results can't be located staff #2 will complete a new national criminal record check (fingerprint) and when the results are received they will be forwarded to the Licensing Inspector. Going forward all new staff will not begin employment until the results of a criminal record check has been received.

Standard #: 8VAC20-770-60-C-2
Description: Based on a review of three staff records, it was determined that the facility did not deny continued employment of a staff who did not have a search of the central registry finding within 30 days of employment.

Evidence:
1. The record for staff #3 did not contain documentation of a completed search of the central registry finding.
2. Staff #3 reviewed the record for the staff #1, and confirmed that the search of the central registry finding has not been received and staff #3 had been employed for more than 30 days.

Plan of Correction: The facility responded: Staff #3 has previously completed the search of the central registry, but we were unable to locate it for viewing during the inspection. If it can't be located staff #3 will need to complete a new search of the central registry. All new staff will complete a search of the central registry upon hire and we will ensure it is received within 30 days.

Standard #: 8VAC20-780-160-C
Description: Based on a review of three staff records, it was determined that the facility did not ensure that at least every two years from the date of the first initial screening or testing, staff members shall obtain and submit the results of a follow-up tuberculosis screening.

Evidence:
1. The record for staff #2, contained documentation of TB screening that was dated 10/21/19.
2. Staff #1 reviewed the record for staff #2 and confirmed that an updated TB screening had not been received.

Plan of Correction: The facility responded: Staff #2 will complete an updated TB screening. All staff will complete an updated TB screening two years from the date of their last TB screening.
