Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was initiated on January 6, 2022 and concluded on January 11, 2022. The director was contacted by telephone and a virtual inspection was conducted. There were 38 children present, ranging in ages from two to five years of age, with seven staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of four child records and six staff records were reviewed.

New standards went into effect on October 13, 2021. The facility is not yet in compliance with the following requirements: new requirements for attendance, written abusive head trauma policy, written continuity of care policy, and new requirements for emergency plan. The facility is to work with their inspector to bring them into compliance.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of staff records, the center failed to obtain out-of-state background checks in the required time frame.

Evidence:
1. Staff #5's date of employment was 08/23/2021. A sworn disclosure statement dated 08/08/2021 indicated that the employee had lived in one state outside of Virginia within the past five years.
2. An out-of-state sex offender registry check was to be completed prior to the date of employment. There was not an out-of-state sex offender registry check on file.
3. An out-of-state child abuse and neglect was to be completed within 30 days of hire. There was not an out-of-state child abuse and neglect check completed for Staff #5.
4. Staff verified the date of employment for Staff #5, and that the out-of-state background checks had not been completed.

Plan of Correction: The sex offender check was completed on 01/19/2022. The child abuse and neglect check was sent out on 1/19/2022. In the future all out-of-state background checks will be completed within the required timeframe.

Standard #: 8VAC20-770-40-D-6
Description: Based on a review of staff records, the center failed t ensure that a criminal history background check was not more than 90 days prior to employment.

Evidence:
1. Staff #3's date of employment was 08/03/2021. The fingerprints were dated 05/06/2021.
2. Staff verified Staff #3's date of employment and the date on the fingerprints.

Plan of Correction: Administration was unaware of the 90 day timeframe. The employee was immediately scheduled for fingerprints to be redone. Fingerprints were completed and on file by 01/14/2022.

Standard #: 8VAC20-780-70
Description: Based on review of staff records, the center failed to obtain reference checks prior to the first day of employment.

Evidence:
1. Staff #3's date of employment was 08/31/2021. One of the reference checks was dated 11/21/2021.
2. Staff #4's date of employment was 08/23/2021. One of the reference checks was dated 11/2021.
3. Staff verified the date of employment for both staff members, and the dates the reference checks were completed.

Plan of Correction: Director's reviewed the process for orientation and opted to go through each part of the paperwork with the new staff member during their training day to ensure all paperwork is completed and on file.

Standard #: 8VAC20-780-240-B
Description: Based on review of staff records, the center failed to ensure orientation was completed no later than seven dates of the date assuming responsibilities.

Evidence;
1. Staff #2's date of employment was 12/02/2021. Documentation of orientation was dated 01/10/2022.
2. Staff verified the date of employment and the date the orientation was documented.

Plan of Correction: Directors reviewed the process of orientation and opted to build in a training day out of the classroom before the staff is put on the schedule in the classroom. This will be the procedure for new staff hired from this point.
