22.1 EARLYCHILDHOOD CARE AND EDUCATION

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, document review and a virtual tour of the program.

A renewal inspection was conducted on 01/27/2022. The provider was contacted by Zoom and a virtual inspection was conducted. There were 47 children, ages 7 weeks- 4 years, and 11 staff members present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, staffing and supervision, programs, emergencies and nutrition. A total of 3 children?s records, 3 staff records were reviewed and one manager record was reviewed during the inspection.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and discussion with staff, the center failed to obtain a copy of the criminal record check and a sex offender registry check from any state in which the individual has resided in the preceding five years.

Evidence: The record for Staff 2 contained documentation that Staff 2 had resided outside of the state of Virginia within the preceding five years. The record for Staff 2 contained a documented hire date of 08/16/2021. There was not a criminal record check or a sex offender registry check from all of the states in which the individual had resided in the preceding five years available for review during the 01/27/2022 inspection.

Plan of Correction: Will be submitted.

Standard #: 8VAC20-770-60-B
Description: Based on record review and discussion with staff, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation.

Evidence: The record for Staff 1 had a documented hire date of 07/06/2021. The date on the sworn statement was 08/11/2021.

Plan of Correction: Will double check that they are done.

Standard #: 8VAC20-770-60-C-2
Description: Based on record review and discussion with the staff, the center failed to obtain the finding from a search of the central registry within 30 days of employment.

Evidence:
1. The record for Staff 1 had a documented hire date of 07/06/2021. There were no findings from a search of the central registry available for review on the 01/27/2022.
2. The record for Staff 2 had a documented hire date of 08/16/2021. There were no findings from a search of the central registry available for review on the 01/27/2022.
3. The record for Staff 3 had a documented hire date of 09/27/2021. There were no findings from a search of the central registry available for review on the 01/27/2022.

Plan of Correction: Will submit new forms.

Description: Based on discussion with staff, the center failed to develop written procedures for prevention of shaken baby syndrome or abusive head trauma.

Evidence: Staff 4 stated that the center did not have written procedure for prevention of shaken baby syndrome or abusive head trauma.

Plan of Correction: The procedures will be written.

Standard #: 8VAC20-780-245-L
Description: Based on record review and discussion with staff, the center failed to ensure that there shall at least one staff member on duty who has obtained within the last three years instruction in performing the daily health observation of children.

Evidence: Staff 4 stated that there was not a staff member on duty who has obtained within the last three years instruction in performing the daily health observation of children.

Plan of Correction: Training will be offered within the next month.
