8VAC20-780 PROGRAMS.

Comments:
A self-reported incident was received on September 16th and an investigation initiated on the same day. The investigation was concluded on concluded on September 22nd. The site director was contacted by telephone to initiate the investigation. There were not any children or staff present at the facility. The inspector emailed the site director a list of items required to complete the investigation. The Inspector reviewed one child?s and one staff record, along with any requested program documentation submitted by the facility to determine if required information was complete.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on review of documentation and interview, when supervising children, the center failed to ensure their care and protection.
Evidence:
1 ? A 16-month old child sustained bruises to his arm while in care on September 14th.
a. Video footage shows child 1 being carried first with two arms then with one arm by staff 2.

Plan of Correction: We have taken measures to ensure that all children in our care are protected. We would never allow children in our care to be handled in such a way where they would be harmed or injured and since this incident, All staff have been retrained on how to properly handle children and the
staff member is no longer employed at our center.

Standard #: 8VAC20-780-340-D
Description: Based on record review and interview the center failed to ensure that a program leader is present in each grouping of children.
Evidence:
1 ? On September 14th staff 2 was working alone with the toddler class ages 16 to 24 months old in the role of program leader. However, review of the record for staff 2 did not have documentation of 6 months of programmatic experience or documentation of the required 24 hours of training for program leader qualification.
2 ? Staff 1 stated that staff 2 did not meet program leader qualifications as she did not have the required training or experience to meet the qualification requirements.

Plan of Correction: If a staff member is promoted to program leader, The center will ensure that they will have the required training or experience
to meet the qualification requirements.

Standard #: 8VAC20-780-410-1
Description: Based on interview and review of documentation the center failed to ensure that the action of inappropriately handling a child is forbidden.
Evidence:
1 - Staff 2 stated that she remembered holding child 1 and another child at the same time. Staff 2 stated she had child 1 by both arms and transferred him to one arm as she attempted to tend to another crying child.
2 ? Staff 1 stated that video footage showed staff 2 carrying child 1 by both arms and continued to carry the child by one arm.
3 - A photograph obtained by the center on September 14th and provided for the investigation on September 22nd shows what appear to bruises on the arm of child 1.
