Technical Assistance:
The following standards were discussed with the director:
8VAC20-780-(4)-280-B Hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.
8VAC20-780-(7)-510-L Medication, except for those prescriptions designated otherwise by written physician?s orders, including refrigerated medication and staff?s personal medication, shall be kept in a locked place using a safe locking method that prevents access by children.
8VAC20-780-(3)-245-L There shall always be at least one staff member on duty who has obtained within the last three years instruction in performing the daily health observation of children.

Comments:
A renewal inspection was initiated on 2/17/22 and concluded on 2/24/22. There were 90 children present, ranging in ages from two to five. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of four child records and four staff records were reviewed.
Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and interview, the center failed to obtain an updated central registry check five years since the previous central registry check for one out of four staff records reviewed.

Evidence;

1. The record for staff 4 has a central registry background check dated 9/19/16.
2. The director provided documentation of a central registry background check being mailed on 2/11/22.

Plan of Correction: The director will create a system to ensure background checks are updated every five years.

Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to obtain an out of state sex offender registry check prior to the first day of employment and out of state child abuse and neglect search by the end of the 30th day of employment for each state a potential staff member resided in the past five years.

Evidence:

1. The record for staff 3 documents the hire date as 1/15/20. The sworn statement documented staff 3 lived out of the state of VA within the last five years.
2. The central registry search for the state staff 3 lived in was dated 2/16/22.
3. The director states the sex offender background check was completed in November of 2021. A copy was in the file but was not dated.

Plan of Correction: In the future the director will ensure out of state background searches are completed as required for staff that have lived outside of VA within the previous five years.

Standard #: 8VAC20-780-60-A-8
Description: Based on record review an interview the center failed to obtain a written care plan from a physician for a child with a diagnosed food allergy.

Evidence:

1. During a medication review for child 4 the permission form stated the child was allergic to peanuts. There was no allergy care plan.
2. The director verified they did not have an allergy care plan.

Plan of Correction: Child 4's parents will be advised to provide a written care plan from a physician. In the future, children with a diagnosed food allergy will be required to provide a written care plan from a physician.

Standard #: 8VAC20-780-245-A
Description: Based on record review and interview, the center failed to ensure all staff obtained at least 16 hours of annual training.

Evidence:

1. The record for staff 1 only contained 10 hours of annual training for the timeframe of 2/15/21-2/14/22.
2. The record for staff 3 only contained 12 hours of annual training for the timeframe of 1/15/21-1/14/22.
3. The director verified staff 1 and staff 3 did not have more training hours for the timeframes provided.

Plan of Correction: In the future the director will monitor staff training to ensure each staff obtain the required 16 hours of annual training.
