Comments:
The licensing inspector conducted an unannounced inspection in response to a complaint that was received by the department on September 14, 2021 regarding an allegation of forbidden action by staff. The investigation was initiated on September 14, 2021 and completed on March 15, 2022. On October 25, 2021, the licensing inspector conducted an unannounced inspection from 10:20am to approximately 11:40am. Interviews were completed, observations were made in the center, and documentation was reviewed. The inspector later followed up with the director by telephone to request additional documentation. The preponderance of the evidence gathered during the investigation supports the allegation, therefore the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on interviews and a review of documentation, it was determined that on 09/14/2021 and on 10/19/2021, a staff engaged in a forbidden action by roughly handing children.

1) During interviews, it was reported that on 09/14/2021, Staff #1 was observed pulling a child?s arm to complete an activity, pulling a child?s t-shirt to get the child?s attention, and while changing a child?s pull up, Staff #1 was observed holding the child?s head up with her hand under the child?s chin.

2) On 09/15/2021, Staff #1 received a record of counseling in violation of company policy stating the following: ??on Tuesday, 9/14/2021 ? ?observed [Staff #1] roughly mishandling 3 children while (over) in her class.? The written report stated ?If it?s brought to the director?s attention again that [Staff #1] is mishandling the children in her care, [Staff #1] will be terminated.? The record of counseling was signed by Staff #1.

3) During interviews, it was reported that on 10/19/2021, while on the playground, Child #1 (3-year-old), got upset and began crying. Staff #1 was observed picking the child up simultaneously by both wrists and lifting the child off the ground for approximately 5 seconds and saying "your mommy has to work, go play."

4) During interview, Staff #3 reported that on 09/15/2021, Staff #1 received counseling for rough handling children and was terminated on 10/19/2021 for rough handling another child.

Plan of Correction: Per the Center: "Prior to my inspection, I had already put a plan of correction in place. Staff #1 received a counseling and was required to complete 2 trainings on positive guidance and appropriate engagement with a child. Staff #1 was terminated 10/19/2021."
