8VAC20-780 STAFFING AND SUPERVISION.

A complaint inspection was initiated on March 3, 2022 and concluded on March 24, 2022. A complaint was received by the department regarding allegations in the areas of staffing and supervision. The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Standard #: 8VAC20-780-80-A Complaint related: No Description: Based on observations of classrooms, review of facility attendance records and interviews with staff, facility did not ensure for each group of children that there is a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.
Evidence: The following was found during inspection on March 3, 2022:
1. Ten children were observed in the classroom identified by staff as the "Toddler" room however seven children were signed in for attendance in that room.
2. Seven children were observed in the 2's classroom however four children were signed in for attendance in that room.
3. Staff #1 stated that parents are responsible for signing in their child(ren) and that sometimes they do not follow through as requested.
4. Staff #1 confirmed attendance roster was not consistent with the number of children present and told classroom staff they needed to sign in those children.Plan of Correction: Facility is making sure each staff is checking the attendance as parents bring in their child. If parents do not sign them in, staff will sign them in.
Standard #: 8VAC20-780-350-B Complaint related: No Description: Based on observations of classrooms and review of children records, facility did not ensure the required staff-to-children ratio is met when children are in care.
Evidence: The following was found during inspection on March 3, 2022:
1. At approximately 8:15 AM, two staff were observed with eleven children in the infant room. Child # 1 (age 2 months) was the youngest in the group.
2. At approximately 8:25 AM, one staff was observed with eight children in the classroom referred by staff as the "toddler" room. Child #2 (age 14 months) was the youngest in the group.
3. Child #1 (age 2 months) and child #2 (age 14 months) are infant age children therefore one staff is required for every four children.Plan of Correction: Staff schedules were rearranged so that staff are coming in earlier to meet ratio requirements.
