22.1 EARLYCHILDHOOD CARE AND EDUCATION

Comments:
An announced non-mandated inspection of a self-reported incident took place on-site on 03/23/2022. The inspector reviewed video footage, interviewed 3 staff members and reviewed 1 staff record. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on the review of required policies and procedures and interviews with staff, the center failed to maintain the operational responsibility of the licensee to ensure that the center?s activities, services and facilities are maintained in compliance with the center?s own policies and procedures that are required by the standards.

Evidence:
1. The video footage confirmed that on 03/18/2022, Staff 1 did not follow the center's Discipline Policy when Staff 1 threw shoes at Child 1, determined to be 3 years old, striking Child 1 in the head twice and roughly placing Child 1 in a chair three times. The center's Discipline Policy states ?Corporal punishment, which includes: spanking, shaking, and slapping is prohibited. Punishment or the threat of punishment, which is humiliating, frightening, causes pain or discomfort to the child is not allowed?.
2. The record for Staff 1 contained documentation of having received training in this policy on 11/03/2015.

Plan of Correction: Will meet with the staff monthly to communicate with them. All staff have been retrained and were given another copy of the staff handbook.

Standard #: 8VAC20-780-350-B
Description: Based on record review, the review of video footage and discussion with staff, the center failed to maintain the required staff-to-child ratio for children 2 years old; 1 staff member for every 8 children.

Evidence: Video footage verified that there were 10 children and 1 staff present in the 3 Year Old Class on 03/18/2022. The review of the date of birth for Child 2 determined that Child 2 was 2 years old; a 1:8 ratio was required. Staff 2 stated that they thought Child 2 was 3 years old.

Plan of Correction: Will maintain the required ratio for the age in care.

Standard #: 8VAC20-780-410-1
Description: Based on the review of video footage and interviews with the staff, the center failed to ensure that actions towards children that are forbidden by the standards (physical punishment, striking a child, roughly handling or shaking a child) were not used at the center.

Evidence: The video footage from 03/18/2022 at approximately 9:00 a.m. shows Child 1, determined to be 3 years old, laying on the floor kicking their feet. While Child 1 is kicking, one of their shoes comes off and lands near Staff 1. Child 1 then sits up, takes off the other shoe and throws it in the direction of Staff 1. Staff 1 picks up one of the shoes and throws it at Child 1 striking Child 1 on the left side of their head. Staff 1 then picks up the second shoe and throws it at Child 1 striking Child 1 on the top of their head. Child 2, determined to be 2 years old, then picks up one of the shoes and gives it to Staff 1. Staff 1 throws the shoe at Child 1 a third time, this time Child 1 deflects the shoe using their arms. Staff 1 then proceeds to pick up Child 1 and forcefully places Child 1 in a chair. Child 1 stands back up and Staff 1 picks up Child 1 again and forcefully places Child 1 in the chair a second time and then walks away. Once Staff 1 walks away, Child 1 gets up and runs to the other side of the room. Staff 1 goes over to Child 1, pulls Child 1 by the arm back towards the chair and then forcefully places Child 1 in the chair a third time.

Plan of Correction: The staff was immediately terminated and all current staff have been retrained.
