Comments:
A monitoring inspection was initiated on site on 3/29/2022 with center administration and concluded on 4/6/2022. There were 71 children present, ranging in ages from 8 months to 12 years, with 10 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 child records and 4 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of four staff files, the facility failed to obtain required background checks for any state in which an employee has resided in the preceding five years. Evidence: Staff 2 (date of hire 11/29/2021) indicated on the sworn disclosure statement that she had resided in another state (CA) in the past five years. The facility failed to obtain a copy of the results of a criminal history record check and a sex offender registry check prior to employment. The center failed to submit an out of state child abuse and neglect search within 30 days of hire. Center staff confirmed the check had not be sent.

Plan of Correction: Center administration will submit the required out of state checks.

Standard #: 8VAC20-770-60-C-2
Description: Based on review of four staff files, the facility failed to have documentation of a completed search of the central registry (CPS check) within 30 days of employment for each staff. Evidence: there was no completed search of the central registry on file for Staff 1 (date of hire 12/27/2021), Staff 2 (date of hire 11/29/2021), or Staff 3 (date of hire 2/28/2022). There was no documentation of a CPS check having been sent within the first seven days of employment or documentation of having followed up with Central Registry within 30 days of employment to check the status of the CPS checks.

Plan of Correction: Center administration will follow up with Central Registry.

Standard #: 8VAC20-780-70
Description: Based on review of four staff files, the facility failed to have documentation of two or more references for each staff prior to employment. Evidence: Staff 2 (date of hire 11/29/2021) and Staff 3 (date of hire 2/28/2022) did not have documentation of two references in the file.

Standard #: 8VAC20-780-510-B
Description: Based on review of eight medications, the facility failed to have written parental authorization to administer two medications. Evidence: the short term medication authorizations signed by the parent for two medications for Child 1 expired 2/22/2022. The short term medication authorization for one medication for Child 2 expired 2/25/2022. There was no written long term authorization for the three medications from a physician.

Plan of Correction: Updated authorizations will be obtained or the medications will be sent home.
