Technical Assistance:
Please send your inspector documentation that the required background checks for Staff #3 and Staff #4 have been requested no later than 5/2/2022.

Comments:
A monitoring inspection was initiated on 4/12/2022 and concluded on 4/19/2022. There were 22 children present ranging in age from 6 months to 4 years old with 5 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies, and nutrition. A total of 4 child records and 4 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of records and interview, the licensee was unable to demonstrate that she obtained a copy of the results of a criminal history record information check, a sex offender registry check from any state which the individual has resided in the preceding five years.
Evidence:
Four staff records were reviewed.
The record for staff #3 who was hired 4/7/2022, contained a signed Sworn Statement of Affirmation that documented that Staff #3 resided in Hawaii in the past 5 years.
The record for Staff #3 did not contain the results of a Hawaii Sex Offender Check.
The record for staff #4, who was hired 4/5/2022, contained a signed Sworn Statement of Affirmation that documented that staff #4 resided in New Mexico within the past 5 years.
The record for staff #4 did not contain the results of a New Mexico Sex Offender Check.
The record for staff #4 did not contain the results of a New Mexico Criminal Record Check.
The program director was unable to furnish the requested documentation of the above background checks requested during the inspection.

Plan of Correction: The Program Director will request a New Mexico Criminal Records Search and Sex Offender Search for staff #4 and a Hawaii Sex Offender Check for staff #3 within 10 days of receipt of this violation notice dated 4/25/2022.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the licensee did not ensure that all areas and equipment of the center, inside and outside, are maintained in a clean, safe, operable condition.
Evidence:
The licensing inspector observed two nails protruding with the sharp end of the nails pointed on to the interior side of the gate on the playground used by children for outdoor play. Two additional nails were observed to be protruding from an adjacent fence panel with the sharp end of the nails pointed to the interior side of the fence panel on the playground used by children for outdoor play.
The program director was shown the protruding nails and acknowledged that they needed to be removed.

Plan of Correction: The program director stated that she would have the individual that helps with maintaining the physical property remove the nails or adjust them so that they do not protrude from the wood before the end of the week.

Standard #: 8VAC20-780-320-B
Description: Based on temperature readings with a digital thermometer, the licensee did not ensure that restrooms for children have sinks located near the toilets that are supplied with running warm water that does not exceed 120 degrees Fahrenheit.
Evidence:
The water from the hot water faucets located in the preschool bathroom sink and the infant handwashing sink measured 131.5 degrees Fahrenheit with a digital thermometer during the inspection.

Plan of Correction: The program director will either lower the temperature at the water heater or install mixers at the sinks where children wash their hands, to ensure that the water measures no more than 120 degrees Fahrenheit.
