22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A renewal inspection was conducted on March 29, 2022 and concluded on April 4, 2022. On March 29, 2022, the licensing inspector was onsite from approximately 3:30 pm until 5:00 pm. The director assisted with the inspection. There were 21 children present, ranging in ages from five years to nine years, with three staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of three child records and four staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on review of four staff records and interview, the center failed to deny employment to anyone who has been convicted of any barrier crime as defined in ? 19.2-392.02 within or outside the Commonwealth.

Evidence:

Staff #4, hired 10/18/2021 had a national fingerprint background check dated 10/18/2021 with a "not eligible" status for employment in child care. During interviews, Administration confirmed staff #2 was currently employed and working at the center.

Plan of Correction: Per the agency's home office administration: Effective today, Staff #4 was removed from the licensed center and will not be working in licensed childcare at the Y.

Standard #: 8VAC20-770-60-B
Description: Based on review of four staff records, the center did not obtain a completed sworn statement prior to the first day of employment for one staff member.

Evidence:

The record of staff #3, hired 12/07/2021, had documentation of a sworn statement dated 02/17/2022 exceeding the first day of employment.

Plan of Correction: Per the agency's home office administration: 1. We have worked on a process to collect this moving forward. 2. We will make sure to have this process completed before all staff?s hire date and correctly filled out.

Standard #: 8VAC20-770-60-C-2
Description: Based on review of four staff records, the center did not obtain a central registry finding within 30 days of employment or volunteer services for two staff members.

Evidence:

1. The record of staff #1, hired 01/19/2022, had documentation of a central registry check dated 04/05/2022 exceeding 30 days from employment.
2. The record of staff #4, hired 10/18/2021, had documentation of a central registry check dated 12/06/2021 exceeding 30 days from employment.

Plan of Correction: Per the agency's home office administration: 1.we will make sure to keep track of all proof of CRS?s being sent out and for the 30 day followup. We have worked on a process to collect this moving forward.
2, We will make sure to have this process completed before all staff?s hire date and correctly filled out.

Standard #: 8VAC20-780-160-A
Description: Based on review of staff records, the center did not ensure staff submitted documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children.

Evidence:

The record of staff #1, hired 01/19/2022, had documentation of a negative tuberculosis screening dated 03/23/2022 exceeding the first day of employment.

Plan of Correction: Per the agency's administration: we will ensure staff obtain and submit tuberculosis screening results by the first day of hire.

Standard #: 8VAC20-780-510-L
Description: Based on observation and interview, the center did not ensure medication, except for those prescriptions designated otherwise by written physician's orders, including refrigerated medication and staff's personal medication, were kept in a locked place using a safe locking method that prevents access by children.

Evidence:

The unlocked first aid kit contained packages of ibuprofen. The first aid kit was stored in the supply closet accessible to children in care. Children were observed entering the supply closet to retrieve art supplies.

Plan of Correction: Per the director: I will remove the medication from the first aid kit and secure it in a locked place until it can be disposed of properly.
