Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint received by the department on 01/25/22 regarding the center?s physical plant and building maintenance. The investigation was initiated on 02/28/22 and completed on 05/20/22. On 02/28/22, the inspector was on site from 3:00pm to 3:20pm. Interviews were completed, observations were made at the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports the allegations, therefore the complaint is determined to be valid. Any violations not related to the complaint, but identified during the course of the investigation can be found on the violation notice.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on observation and interview, the center did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence: During the inspection on 02/28/22, the following was observed -
1) In the Infant/Toddler playground, the plastic coating on the swing set chain was broken in several places creating sharp edges and exposing the chain. Rust was observed on the exposed portion of the chain.
2) In the Infant/Toddler playground, a toy basketball hoop was observed in the area where the children play. The toy had a broken piece with sharp edges around it. During interview, it was reported the children play with the toy.
3) In the Infant/Toddler playground, a red riding toy was observed with a broken steering wheel. The broken piece had sharp edges around it. During interview, it was reported the children play with the toy.
4) In the Infant/Toddler playground and in the Preschool/School Age playground, the fence had several warped wood planks that created gaps at the bottom of the fence, creating a pinching hazard.
5) The play equipment in the Preschool/School Age playground had rust stains throughout the equipment. Broken plastic screw heads were observed throughout the equipment with sharp edges around it. During interview, it was reported the children use this equipment.
6) The picnic tables located on the playground were damaged with cracks and missing plastic on the seats and on the table tops. During interview, it was reported the children and the staff use the picnic tables.
7) Some of the wooden planks around the Preschool/School Age playground had splintered and deteriorating wood.

Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin.

Plan of Correction: Per the Center: "All three items were immediately removed from playground after inspection. Equipment will be checked weekly and logged.

Maintenance employee will be working to replace warped boards by June 6th, 2022.

Another maintenance employee will also be removing the rust stains and painting, and replacing plastic screw heads by June 3rd, 2022.

Picnic tables were replaced.

Wooden planks will be removed by June 15th, 2022. (Weather permitting)."

Description: Based on observation of the center?s playground, the center did not ensure that all portable wading pools were emptied, sanitized and stored in a position to keep them clean and dry.

Evidence: 1) During the inspection on 02/28/22, there was a small portable wading pool in the outdoor play area that had not been used for wading that had rain water, leaves, and dirt in it. 2) During interview, it was reported the pool was not stored in a position to keep it clean and dry.

Plan of Correction: Per the Center: "Wading pool has been removed. Teachers will monitor and relay any issues to [Director] or [Assistant Director]. [Assistant Director] and [Director] will check playground weekly and keep a log.
