Technical Assistance:
It was reviewed with the Program Director that children?s records must indicate any chronic physical problems and pertinent developmental information and any special accommodations needed.
Parents shall be provided at least semiannually in writing information on their child?s development, behavior, adjustment and needs. Such sharing of information must be documented.

Comments:
A monitoring inspection was conducted on 3/17/2022 in response to an incident reported by the facility on 3/11/2022.
The investigation included the review of documentation and interviews.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Non-compliance was reviewed with the Program Director during an exit interview at the close of the investigation.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based upon review of written policies and procedures and staff interview, the licensee has not ensured that the center?s activities and services are maintained in compliance with the
Standards and the center?s own policies and procedures required by the Standards.
Evidence:
1. The facility?s policies and procedures in the Parent Handbook, as well as the Personnel Policy Handbook, regarding the disciplining of children state that ?There will be no physical
punishment or disciplinary action to any part of the body?.
2. Three witnesses interviewed described the action of staff 1 in response to behavior by
child 1 (ten years old) that was posing imminent danger to the safety of the children and
staff as the following:
a. Child 1 face down on the floor with staff 1?s ?arms wrapped around his arms? and her ?full body weight? on him.
b. Staff 1 ?took (child 1) down? and ?restrained him?. Staff 1 was ?on him or to the side of him?.
c. Child 1 was ?face down with (staff 1) on his back?. Staff 1?s ?legs were on child 1?s right
side? and her ?torso was on (child 1)?.

Plan of Correction: The facility responded with the following:
1. Held a meting with all staff regarding the personnel Policy Handbook and went over the disciplinary state noted and what that means and had each staff sign that they received and understood the policy handbook.

Standard #: 8VAC20-780-80-A
Description: Based upon staff interview, the facility has not ensured that they maintain for each group of children, a written record of daily attendance that documents the arrival and departure of each
child in care as it occurs.
Evidence:
1. Staff 2, the Program Director, was unable to provide documentation of children?s attendance including the arrival and departure times of each child in each grouping of
children.
2. Each classroom did not document the arrival and departure of each child in the classroom as it occurred.

Plan of Correction: The facility responded with the following:
Program Director printed the model sign in and sign out given to record daily attendance in each room in accordance to the licensing standard.
