Comments:
An unannounced renewal inspection was initiated and concluded on 03/31/2022. At the time of inspection there were 22 children present with 3 staff supervising. Children were observed eating lunch and playing at various stations in the classrooms.

A total of 4 children records, 5 staff records, and 1 agent record were reviewed. The physical plant, emergency drills, emergency supplies, and medication were also reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on record review, a fingerprint-based criminal history check was not obtained for 2 of 5 staff members reviewed prior to their date of employment.

Evidence:
1. Staff #2 began employment on 8/30/21. The fingerprints in the record for Staff #2 were dated 2/28/22.
2. Staff #3 began employment on 8.30/21. The fingerprints in the record for Staff #3 were dated 9/13/21.

Plan of Correction: We will begin the process for background checks at the time of the interviews moving forward.

Standard #: 22.1-289.035-B-4
Description: Based on record review, the child day center did not obtain a copy of the results of a criminal history record information check, sex offender registry check, and a search of the child abuse and neglect registry from any state in which the individual has resided in the preceding 5 years within required time frames for 2 staff.

Evidence:
1. Documentation in the record for Staff #2 (start date 8/30/21) indicated Staff #2 has resided outside of the state of Virginia in the past 5 years. The out of state child abuse and neglect check results were dated 3/29/22. The out of state sex offender registry check results were dated 2/25/22. The out of state criminal history record check results were dated 3/29/22.
2. Documentation in the record for Staff #5 (start date 7/30/19) indicated Staff #5 has resided outside of the state of Virginia in the past 5 years. The out of state child abuse and neglect check was dated 8/2/12. There was no documentation of a sex offender registry check or out of state criminal history record check in the record for Staff #5.

Plan of Correction: We will begin the process for obtaining backgrounds at the time of interview moving forward. Documentation of requests for missing backgrounds will be provided within the next 10 business days.

Standard #: 8VAC20-770-60-C-2
Description: Based on record review, the child day program did not have a central registry finding within 30 days of employment for 1 staff.

Evidence:
1. Staff #2 began employment on 8/30/21. The central registry check results in the record for Staff #2 were dated 2/22/22.

Plan of Correction: We will begin the process for backgrounds at the time of the interview moving forward.

Standard #: 8VAC20-780-70
Description: Based on record review, 2 of 5 staff records reviewed did not contain all required information.

Evidence:
1. The record for Staff #1 and Staff #2 did not contain documentation that 2 or more references were checked before employment.
2. References for Staff #1 (start date 8/19/21) were obtained on 9/2/21 and 9/14/21.
3. References for Staff #4 (start date 8/19/21) were obtained on 9/2/21.

Plan of Correction: We will request references at time of interview.
