A focused monitoring inspection was initiated on 5/2/2022 and concluded on 5/13/2022 regarding a self reported incident that occurred on 4/29/2022 and was reported to the department on 5/2/2022. The inspector reviewed compliance in the areas of of administration, physical plant, staffing and supervision, programming, special care and emergencies and child abuse / neglect.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-340-A Description: Based on interviews of staff and written documentation, the licensee did not ensure that when staff are supervising children, they always ensure their care. Protection, and guidance.
Evidence:
On April 29, 2022, children were gathered in a combined group eating lunch at the front reception area with staff #1 and staff #3.
The written report completed by staff #1, stated that child #2 (7 years old) had already eaten lunch and was sent to his cot at the other end of the facility when a five year old child (child #1) asked to use the restroom and was sent, alone, from the front lobby area to the restroom. Staff #1 stated that staff #2 called to her for assistance from the doorway of the boys? restroom at about 12:05.
In Staff #2?s written statement, she indicated that at 12:05 p.m. she went to assist another child in the girl?s restroom when she saw that child #1 and child #2 were in the boys restroom and observed that they were inside of a bathroom stall together.Plan of Correction: The following plan of correction was received in writing by the department on 7/18/2022:
?No child is left alone! While lunch is being prepared two staff members are in the front area with the children until their lunch is prepared. While another staff member is placing cots down. Once all cots are placed down then all teachers are with the children. Once all children are finish eating lunch one teacher is standing in the middle of both restrooms watching the children use the restroom and maybe assisting with hand washing. Once all children have used the restroom they are placed on their cots while each teacher is within sight and sound monitoring the children during quiet time. The one staff member that was making lunches (unauthorized) has chosen to quit! ?
Standard #: 8VAC20-780-340-F Description: Based on interviews of staff and written documentation, the licensee did not ensure that Children under 10 years of age are always within actual sight and sound supervision of staff, or that staff are able to hear a child who is using the restroom provided that all additional required criteria of the standard are met.
Evidence:
On April 29, 2022 at approximately 12:00 p.m., children were gathered in a combined group at the front reception area with staff #1 and staff #3 where they were finishing lunch.
According to an interview with staff #3, children who have finished eating are sent 2 at a time to each of the two restrooms at the opposite end of the building where a third staff (staff #2) is normally located. Once they are finished in the restroom, the children are supposed to go to their cots which are located in the classroom area just outside of the restrooms and adjacent to the kitchen.
Staff #2 stated in a written incident report that she was in the kitchen preparing additional food when at approximately 12:05 p.m. she exited the kitchen to assist another child in the girl?s bathroom. Staff #2 confirmed that she was not aware, until that moment when she saw him, that child #1 (age 5 years old) was in the boy?s restroom and that he was no longer with staff #1 and staff #3 at the front of the building.
Child #1 was out of sight and sound supervision between approximately 5 and 10 minutes before staff #2 discovered him in the restroom.Plan of Correction: The following plan of correction was received in writing by the department on 7/18/2022:
