Comments:
Thank you for your assistance during this unannounced inspection. This inspection was initiated by a self reported incident that was received by the department on June 6, 2022. The on-site visit was conducted on June 9, 2022 with representatives from two other agencies. Interviews were conducted between June 9, 2022 and June 21, 2022. Non-compliance with applicable standards or law were identified during the investigation and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected sections for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s): 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 8VAC20-780-400-B
Description: Based on interviews conducted, program failed to ensure that
behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. In interview conducted on 6/15/2022, witness stated that on 6/6/2022 she heard Staff #1 loudly say to Child #1, ?You better apologize or I?m going to whoop your butt.? Staff #1 then approached Child #1, took his hand, and in an appropriate manner, directed the child to a chair.
2. In interview conducted on 6/16/2022, Staff #1 stated that Child #1 had pushed Child #2 into the rug, and that she had said, ?I?m going to get your butt,? never intending to act on the threat. Staff #1 then redirected Child #1 to a chair for timeout and discussed the importance of having nice hands.
3. In interview conducted on 6/21/2022 Staff #2, who was speaking with the witness during the incident, confirmed Staff #1?s comments to Child #1 and seemed to be made out of frustration, but that she was never physically aggressive with the child.

Plan of Correction: Due to the violation that occurred on June 6, 2022, Wonder Land Enrichment Center will do the following steps in order to comply with the standards of Virginia Department of Education. Based on interviews conducted, our program failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to the appropriate behavior and resolve conflicts.
Steps to correct the non-compliance with the standards:
1. Staff #1 remained out of work without pay from 6/6/2022- 7/14/2022 while the investigations were conducted with CPS, police, and the Virginia Department of Education.
2. Staff #1 will return to work under a 30 probationary period. During this time, she will remain under the guidance of another staff member at all times.
3. Staff #1 will complete training on Child Abuse and Neglect within 30 days of probation.
4. Staff #1 will complete training on CLASS dimensions.

Steps to prevent the non-compliance from recurrence:
I. All staff will receive training on Wonder Land Enrichment Center's Discipline Policy (Attached). This is originally done during orientation, but will be reviewed in depth on August 6th at the mandatory staff meeting.
2. All staff will receive CLASS training on August 31st by Marta Szuba with Virginia Quality/ RMH.
3. All teachers will receive CLASS observations in the Fall and Spring. Random administrative observations will also be conducted.
