Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint received by the department on 02/25/2022 regarding an allegation of administration and behavioral guidance. The investigation was initiated on 02/28/2022 and completed on 08/15/2022. On 02/28/2022, the inspector was on site from 2:00pm to approximately 3:20pm. Interviews were completed, observations were made at the center, and documentation was reviewed. The inspector completed additional interviews and follow-up activities at the facility on 03/22/2022 from approximately 8:30am to 10:15am. Additional interviews were conducted off-site and additional information was submitted to the inspector electronically. The preponderance of the evidence gathered during the investigation supports the allegations, therefore the complaint is
determined to be valid. Any violations not related to the complaint, but identified during the course of the investigation can be found on the violation notice.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

The provider's responses for the 'plan of correction' were not received as of 08/24/2022 and will not appear on this Violation Notice.

Description: Based on a review of the center?s policies and procedures, the center did not ensure that the
center's policies and procedures regarding acceptable and unacceptable discipline measures were followed.

Evidence:
1) The center's policies on discipline were not followed on 02/24/2022 when Staff #1 yelled at
Child #1 (3-years-old) for approximately three consecutive minutes when Child #1 was running around in the classroom and ?out of control.?

2) The licensing inspector reviewed the center?s policies and procedures on discipline.
The policies state: "?Our teachers practice cause and effect discipline methods and under
no circumstances yell, threaten, or belittle children in any manner. Violation of these rules
result in automatic termination of the staff member.?

Plan of Correction: The Director was terminated. The current Director will meet regularly with individual teachers to provide observations and feedback on any discipline measures implemented in the center. The Director will document observations and feedback given to all employees regarding discipline measure utilized in the center.

Description: Based on interviews and documentation reviewed, the center did not ensure behavioral guidance was constructive in nature, or age and stage appropriate.

Evidence:
1) During interviews, it was reported that on 02/24/2022 at approximately 12:00pm - 12:05pm, Staff #1 was overhead yelling at a child for approximately three consecutive minutes. Staff interviewed reported Child #1 (3-years-old) was running around in the classroom and ?out of control.? Staff #1 acknowledged using a ?stern tone? with Child #1 after Child #1 was asked to sit and settle down for nap multiple times.

2) During interview, Member of Management #1 acknowledged that around nap time on 02/24/2022, Staff #1 raised her voice at Child #1 when Child #1 was running around in the
classroom. Staff interviewed reported Child #1 did not settle down after she was asked to sit
several times until she ?wore herself out.?

3) In documentation reviewed dated 02/25/2022, Member of Management #1 stated: "?I did handle the situation immediately and followed up with the teacher later in day at length. I will also do additional training with her.? Yelling is not behavioral guidance that is constructive in nature, or age and stage appropriate for three year old children.

Plan of Correction: We will provide coaching and observations to make sure behavioral guidance is constructive in nature, or age and stage appropriate for each age group. The Director will meet with employees on a regular basis to address any behavioral issues within the classrooms. The Director will keep written documentation of all coaching, observations, or behavioral issues within a classroom.
