A complaint was received in the licensing office on 6/27/2022 regarding the release of child records. On 7/13/2022 an on-site investigation was conducted. Interviews were conducted and records were reviewed. Additional information was obtained from electronic records. At the conclusion of this investigation, the preponderance of evidence supports the allegation and the complaint is deemed valid. Any violations associated with the investigation can be found listed on the Violation Notice.

Standard #: 8VAC20-780-140-A Complaint related: No Description: Based on a review of children's records, all children did not have a physical examination on file before the child's attendance; or within 30 days after the first day of attendance.
Evidence:
1. Child #1 (doe: 4/19/2022) did not have a physical examination on file at the time of the inspection.Plan of Correction: We will ask the parents for this.
Standard #: 8VAC20-780-50-A Complaint related: No Description: Based on a review of records, children's records were not made available to parents on request, unless otherwise ordered by the court.
Evidence:
1. Multiple written email requests were made for a copy of Child #1's records that are on file at the facility, by a parent of Child #1. These requests were made on June 7th, 17th, and 26th. The facility did not provide a copy of the requested records to the parent until July 13th.
2. There is no custody order of any kind on file at the facility for Child #1.
3. An additional request was made by the parent for a copy of Child #1's attendance records on July 20th, 2022. The records were not released to the requesting parent until August 9th, 2022.Plan of Correction: The requested records have been released to the parent. Moving forward, we will release records as required.
