Please remember that using signage and cautionary tape to place a piece of play equipment off limits is a temporary solution and cannot be the permanent fix. Because the mulch has degraded to dirt, you will need to dig out all of the dirt and replace with new mulch or some other acceptable resilient surfacing.

Consultation provided on timeframes for background checks, tuberculosis tests and the new components ( as of 10/21) of orientation training.

Comments:
An unannounced monitoring inspection was conducted with the director from 11:20 am to 1:30pm. The director was present with 31 children with 10 staff providing supervision. Ten children and 3 staff were off site at a pumpkin patch during the inspection.

The Licensing Inspector was able to observe lunch being served, which consisted of beef ravioli, mixed vegetables, pineapple, mozzarella stick, bread and milk. After lunch, the children transitioned to naptime.

Three new staff files were reviewed as well as six children's files. A sample size of 6 injury/accident reports were reviewed as well.
There was medication on site for one child.
The areas of non compliance are outlined on the violation notice.

Violations:
Standard #: 8VAC20-770-60-B
Description: Based on interview and a review of staff files, it was determined that one staff did not have a sworn disclosure background check on file prior to employment.
Staff A was hired and their first day of employment was on 10/17/22, and there was no sworn disclosure statement on file for this staff.

Plan of Correction: We had the staff sign the sworn disclosure statement at the time of the inspection. We will make sure to have this statement signed before employment.

Standard #: 8VAC20-780-160-A
Description: Based on a review of three staff files and an interview with the director, it was determined that two staff did not have a tuberculosis test/screening on file prior to employment.
Evidence:
Staff A was hired/employed on 10/17/22 and there was no tuberculosis test/screening on file.
Staff B was hired/employed on 9/14/22 and there was no tuberculosis test/screening on file.

Plan of Correction: We will make sure to obtain the tuberculosis test/screenings prior to employment.

Standard #: 8VAC20-780-40-M
Description: Based on observation, a review of the allergy/sensitivity/dietary restriction form and interviews with staff, it was determined that the center is not maintaining a written list of all children's allergies/sensitivities/dietary restrictions.
Evidence:
Child A is lactose intolerant, but was not placed on the list; child B has a dietary restriction of no pork, but was not placed on the list.

Plan of Correction: We will redo the allergy/sensitivity/ dietary restriction list . We will make sure to revise the list immediately when needed. We will make sure to document on the last the date of revisions.

Standard #: 8VAC20-780-240-C
Description: Based on interview and a review of staff files, it was determined that staff were either missing components of orientation training or did not have orientation training.
Evidence:
Staff B was missing components of orientation training to include prevention of sudden death syndrome and use of safe sleep practices, prevention of shaken baby syndrome, abusive head trauma and coping with crying babies and distraught children, recognizing the symptoms of allergic reaction, responding to allergic reaction, preventing exposure to allergies, preventing cross contamination.
There was no documentation that staff C ( hired 5/24/22) has obtained orientation training.

Plan of Correction: We will add the missing components of orientation and redo all orientation.

Standard #: 8VAC20-780-270-A
Description: Based on observation, it was determined that the center was not maintained in a safe and operable condition.
Evidence:
The Licensing Inspector observed seriously cracked window panes in the school age classroom. Tape was used on some of the cracks in an attempt to reinforce the windows.

Plan of Correction: We will repair the window panes.

Standard #: 8VAC20-780-330-B
Description: Based on observation, it was determined that resilient surfacing was not underneath play equipment.
Evidence:
The Licensing Inspector observed on the 3/4/5/schoolage playground a blue/green composite play structure that requires at least 6 inches of resilient surfacing underneath and six feet surrounding the structure.
There was no resilient surfacing underneath and around this play equipment as the mulch that was once there had degraded and turned to dirt and is no longer a resilient surface.

Plan of Correction: We will place the play structure off limits via sinage and caution tape. We will remove the compacted dirt and replace it with mulch to ensure at least six inches
