Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received on August 1, 2022 regarding allegations of behavioral guidance and forbidden actions. The inspection was initiated on October 7, 2022 and completed on October 12, 2022. On Friday, October 7, 2022, the inspector was on site from approximately 10:50 AM to 1:10 PM. Interviews with staff were completed, observations were made in the center, and documentation and video footage from June 24, 2022 was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for details.

Complaint related: No
Description: Based on a review of video footage and interviews, the center did not maintain operational responsibilities to include ensuring that all activities, services, and facilities are maintained in compliance with these standards and the center's own policies and procedures that are required by these standards.

Evidence:
Staff #2 was observed in video footage roughly handling a child on the playground. Staff #3, staff #5, and staff #6 observed staff #2 engage in ?rough? handling of children. The center?s policies and procedures under discipline states: ?Magnolia Ridge permits no physical punishment of any kind? and ?Our teachers practice cause and effect discipline methods and under no circumstances yell, threaten, or belittle children in any manner. Violation of these rules result in automatic termination of the staff member?.

Plan of Correction: This incident occurred on June 24, 2022. It was recorded by a staff member and given to management the same day, within an hour. The staff member observed on video and the Director were terminated immediately. This was corrected on June 27th, 2022, the following business day by termination of both parties. We have now implemented a video surveillance system in all areas of our school, including outside playground areas. This video is saved to our security company cloud on a 24/7 basis. The new Director has given feedback and training in all areas of Early Childhood Development. The new Director will be consistently monitoring all areas of the center to ensure the safety and well-being of all our children. The new Director has also gone over proper Mandated Reporting Requirements and the consequences for not reporting under the Virginia State Law for all mandated reporters. The new center Director is dedicated to making sure these issues never arise again.

Description: Based on interviews, the center did not ensure that in order to promote the child's physical, intellectual, emotional and social well-being and growth, staff interact with the child to provide needed help, comfort and support.

Evidence: 1. Staff interviews revealed that staff #2 responds to the children in a negative manner. Staff stated that staff #2 is ?harsh? with her tone of voice, is not ?respectful? and ?screams and yells? at the children.

Plan of Correction: This incident occurred on June 24, 2022. It was recorded by a staff member and given to management the same day, within an hour. The staff member observed on video and the Director were terminated immediately. This was corrected on June 27th, 2022, the following business day by termination of both parties. Description: Based on review of video recording provided by the facility and interview, a staff engaged in a forbidden action of rough handling of a child.

Evidence:
On October 8, 2022, video footage of the playground was reviewed. The video revealed that staff #2 roughly handled child A. In the video, child A tells staff #2 that she had a potty accident. Staff #2 walks towards child A and said ?you pooped?. As staff #2 approaches child A, staff #2 brings her right hand around to Child A?s face. Staff #2 pulls child?s face close to her face. Staff #2 leans child A?s face back and child A stands on her toes as staff #2 holds on to child A?s face. As staff #2 removes right hand from child A?s face, staff #2 had left hand on the back neck area of child A. Staff #2 is observed using her left hand to push child A forward.
