Technical Assistance:

Reviewed out of state background check requirements to include those non-NFF states/ territories that requires a criminal record check ( prior to employment) and the need to obtained child abuse and neglect background checks from those states for all staff who have lived outside of the state of Virginia in the last five years.

Please make sure all latches to cabinets in the classrooms are functioning properly and are able to lock those items that require locking.

Consultation provided on the list of all children with allergies, sensitivities, and dietary restrictions.

Make sure all of your injury/accident forms contain a way to prevent reoccurrence component.

The dome climber must be placed off limits with clear sinage and caution tape until removed from its current location and brought into compliance.

In order for mulch to remain resilient, it will often need to be raked and fluffed in the use zones. Once the mulch starts to break down and turn to dirt, the only remedy would be to remove the dirt and replace with new mulch. Keep a close eye on your mulch and once any of the six inches starts to turn to dirt you will need to replace it.

Comments:
An unannounced monitoring inspection was conducted with the director and administrative staff from12:30 pm to 3:10 pm. Eighty one children were present with 13 staff providing supervision. The ages of the children ranged from 2 months to 4 years of age.
For lunch, the children were provided sloppy joe, broccoli, peaches and milk.
Five staff and children's files were reviewed today. Medications for eight children were reviewed as well.
The most recent fire inspection is dated 2/28/22 and the health inspection is dated 3/15/22.
The areas of non compliance are outlined on the violation notice.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of five staff files and an interview with Administrative staff, it was determined that one staff did not have out of state criminal background checks prior to the first day of employment.
Evidence:
Staff A was hired on 8/23/22 and there was no criminal records background check on file for the District of Columbia and Texas.

Plan of Correction: The criminal background check for Staff A for the District of Columbia and Texas are being submitted tomorrow, November 3, 2022

Standard #: 8VAC20-780-280-B
Description: Based on observation, it was determined that hazardous substances were not kept locked.
Evidence:
1. The Licensing Inspector observed a can of anti corrosion lubricant unlocked on a shelf in the Monkey room, which serves infants.
2. The Licensing Inspector observed window cleaner, sanitizing wipes, and sanitizing spray unlocked on a shelf above the sink in the Flamingo room, which serves 3/4 year old children.
3. The Licensing Inspector observed amonium chloride compound, air freshener spray and nail polish remover in a cabinet unlocked in the Cheetah classroom, which serves 4/5 year old children.
4. The Licensing Inspector observed an unlocked spray bottle of sanitizing agent, in the widow seal near the diapering area in the Butterfly classroom, which serves 2 year old children.

Plan of Correction: Regarding each observation of hazardous substances being kept inside out of reach cabinets without fully operational cabinet locks, each cabinet lock will be replaced this weekend (November 6, 2022). Moving forward, staff has been instructed to notify Administration when the locks begin to lose functionality

Standard #: 8VAC20-780-330-B
Description: Based on observation and measurements, it was determined that there was insufficient use zone for a dome climber on the older playground.
Evidence:
The dome climber requires 6 feet of fall zone, free of hazardous obstacles, however the concrete walkway was within 3 feet of the dome climber.

Plan of Correction: The dome climber has been rendered out of use until it is physically moved to meet the required 6 feet of fall zone, free of hazardous obstacles. In this case, the distance will exceed 6 feet from the concrete walkway it is currently too close to.

Standard #: 8VAC20-780-510-L
Description: Based on observation, it was determined that medication was not kept locked.
Evidence:
The Licensing Inspector (LI) observed two Epinephrine medications unlocked in a cabinet in the Panda's classroom, which serves 3/4 year old children. The LI observed two Epinephrine medications unlocked in a cabinet in the Butterfly classroom, which serves 2 year old children.

Although the medications were out of reach of the children, the latch to the cabinets were broken and therefore was not locked.

Plan of Correction: In response to medications (Epinephrine medications) being out of reach, but in cabinets with non-functioning locks, the cabinet locks will be replaced this weekend (November 6, 2022). Moving forward, staff has been instructed to notify Administration when the locks begin to lose functionality.
