Comments:
A monitoring inspection was initiated on 10/31/2022 and concluded on 11/01/2022. There were 40 children present with 10 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 child records, 2 medication authorizations and 5 staff records were reviewed/updated.

Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Please complete the plan of correction and date to be corrected sections for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s): 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on staff record review and interview, the center did not obtain the required out-of-state background checks from any state in which a staff member had resided in the preceding five years within the required time frame.

Evidence:
1. The record for Staff #2, hired on 09/01/2022, indicated the staff had resided in another state outside of Virginia within the last five years. The results of the criminal history record was dated 09/29/2022.
2. Administration confirmed the out-of-state criminal history record background check was not obtained for Staff #2 within the required time frame.

Standard #: 8VAC20-780-160-A
Description: Based upon review of staff records and staff interview, the facility did not obtain documentation of a negative tuberculosis screening completed within the last 30 calendar days of the date of employment and be signed, by a physician, physician's designee or an official of the local health department.

Evidence:
1. Staff #2's hire date in record was 09/01/2022. The results of the tuberculosis screening/test on file was 07/28/2022.
2. Administration verified Staff #2's date of hire and the date of the tuberculosis screening/test.

Standard #: 8VAC20-780-330-B
Description: Based on observation, playground surfacing measurements taken, the program did not ensure that adequate resilient surfacing (depth of six inches) was maintained under/surrounding the outdoor playground equipment.

Evidence:
1. Observation and resilient surfacing measurements, taken on this date, determined that the resilient surfacing surrounding the playground climbing structure that include a slide and a climbing apparatus were approximately 3 inches in depth.
