22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and an in person tour of the program. A monitoring inspection was initiated on November 16, 2022 and concluded on November 17, 2022. There were 10 children present, ranging in ages from ages 3 to 5, with 2 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 2 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and staff interviews, the licensee did not ensure, all staff had obtained updated background checks as required every 5 years.

Evidence: Staff records were reviewed and 1 out of 2 did not have an updated Child Protective Service Check (CPS). The most recent CPS check was dated 10-12-2017. Staff #1 was observed working during the inspection.

Plan of Correction: An updated CPS check application will be sent out to obtain the update background check.

Standard #: 22.1-289.035-B-4
Description: Based on record review and staff interviews, the licensee did not ensure, all staff had obtained an out of state child abuse and neglect search (CPS) request by the 30th day of employment.

Evidence: Staff records were reviewed and 1 out of 2 did not have background checks as required, as they did not obtain the out of state CPS check for New Jersey where they had lived within the last five years. Staff #2?s first date of employment was 4-12-2021. Staff #2 was observed working during the inspection.

Plan of Correction: Our HR department will check up on the background check so that we can get that check for our records.

Standard #: 8VAC20-780-40-K
Description: The center shall develop written procedures for prevention of shaken baby syndrome or abusive head trauma, including coping with crying babies, safe sleeping practices, and sudden infant death syndrome awareness.
Based on review of center documentation and staff interviews, the licensee did not ensure the center shall develop written procedures for abusive head trauma.

Evidence: Staff #1 confirmed there was not a policy available for review related to head trauma.

Plan of Correction: The written procedures will now be on-site for abusive head trauma.

Standard #: 8VAC20-780-260-B
Description: Based on documentation review and staff interviews, the licensee did not ensure to obtain an annual approval from the health department.

Evidence: The most recent copy of the health inspection available for review was date 9-9-2021.

Plan of Correction: The health inspector will come out on 11-17 to complete annual check.
