The licensing inspector initiated an unannounced remote inspection on 11/7/2022 and concluded on 11/7/2022 in response to a self-reported incident received by the department on 10/31/2022 for allegations regarding ratios and supervision. Interviews were conducted with the staff relating to the allegations. Information gathered during the investigation determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #: 8VAC20-780-340-F Description: Based on interview, the center failed to ensure children were kept within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom.
Evidence:
1. On 10/30/22 a three year old child (child 1) exited the classroom alone. There was one teacher (staff 1) in the classroom with nine children (youngest age three). Staff 1 realized child 1 was missing after she broke up an argument between two children. Staff 1 exited the room and asked the teacher across the hall (staff 2) if she had seen child 1. Staff 2 stated this was approximately 9:30 AM. Staff 2 said she had not seen child 1. Staff 2 stated three to four minutes later staff 1 asked her again if she had seen child 1 and she stated she had not. They found her in the next classroom over by herself playing. The classroom was empty that day.
2. On 10/30/22 staff 1 saw child 1 leave the classroom again. When she went after her she could not find her. Staff 1 asked staff 2 if she had seen child 1 and she stated she had not. Staff 2 stated this was approximately 12:30 PM. Staff 1 immediately began looking for the child and she found her in the same empty classroom alone playing.Plan of Correction: SEE INTENSIVE PLAN OF CORRECTION
Standard #: 8VAC20-780-350-B-4 Description: Based on interview, the center failed to ensure the three's classroom was kept within the ratio of 1 staff member to 10 children at all times.
Evidence:
1. At approximately 9:30 AM (per staff 2) on 10/30/22 staff 1 left the classroom to go look for a child that left the classroom unattended. There were no other staff in the classroom and eight children in the classroom with the youngest being three.
2. At approximately 12:30 PM (per staff 2) on 10/30/22 staff 1 left the classroom to go look for a child that left the classroom unattended. There were no other staff in the classroom and eight children in the classroom with the youngest being three.Plan of Correction: SEE INTENSIVE PLAN OF CORRECTION
