Comments:
A follow-up monitoring inspection was initiated on Thursday, November 10, 2022. The licensing inspector and licensing administrator arrived at the center at approximately 3:00 pm and were prohibited entry to the center until the owner arrived at approximately 3:18 pm. There were 35 children present, ranging in ages from four months to nine years with five staff members. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision. A total of five staff records were reviewed.

The violation noticed was amended on February 3, 2023.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 22.1-289.018-A
Description: Based on observation and interview, the licensee did not afford the Superintendent reasonable opportunity to inspect all of their facilities, books, and records, and to interview their agents and employees and any person living or participating in such facilities, or under their custody, control, direction, or supervision.

Evidence:

During the November 10, 2022 inspection, the following was documented:
Upon the licensing inspector and licensing administrator?s arrival at the center, a person later identified as staff #1 was observed opening the front door of the center for the postal courier. The two licensing agents approached the door at 3:00 pm and knocked multiple times and rang the doorbell without a response from the center. While one of the licensing agents was on the phone with the local police department, the owner arrived at 3:18 pm and proceeded to allow the agents into the center.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the center did not maintain all areas and equipment of the center, inside and outside, in a safe, clean and operable condition.

Evidence:

1. The rocking chair in the infant room had a torn cushion that exposed the interior foam to children in care posing a choking hazard.
2. One nap mat was torn along the edge exposing the interior foam in the preschool classroom.
3. One trike on the playground had a plastic seat that was cracked and missing a piece creating a sharp edge that could snag the skin of a child in care.
4. The infant feeding table had one seat with a broken belt fastener and one seat missing the protective belt.

Standard #: 8VAC20-780-570-A
Description: Based on observation, the center did not ensure when a child was placed in an infant seat, the protective belt was fastened securely.

Evidence:

1. On November 10, 2022, the licensing agents observed four infants sitting in infant seats at the feeding table. All four infants did not have the protective belts fastened.
2. Infant #1, four months in age, was observed sitting in an infant rocking bouncer without the protective belt fastened.
