Comments:
On 9/8/2022 an unannounced investigation was conducted regarding a self-reported incident involving supervision and care and protection of children. This visit was conducted between 2:10pm and 3:10pm. A joint investigation was conducted with Child Protective Services on 9/15/2022. Interviews were conducted, documents were reviewed, and observations were made. After carefully interviewing all involved parties, violations were cited during this investigation and can be found on the Violation Notice. Violations:
Standard #: 8VAC20-780-40-E
Description: Based on staff interview, the licensee did not ensure that they are in compliance with the center's own policies and procedures.

Evidence:
1. There was no documentation available on 9/8/2022 of either the Staff or Management?s Daily Playground Safety Checklist being completed on the date of the incident, 9/2/2022.

2. The center?s Playground Safety Procedures state:
?1. Every day, prior to children using the playground, a member of management must designate a staff member who must complete the following:

-Inspect the Playground using the Daily Playground Safety Checklist for Staff.

2. A member of Management must complete the Daily Playground Safety Checklist for Management and either make the necessary repairs or submit work orders to Facilities.?

3. Staff A stated that ?The playground Safety checklist was not completed that day, 9/2/2022. Staff D usually does the playground safety checklist, but it was not completed that day.?

4. Staff E stated that ?No one did the morning safety checklist to make sure all of the gates are secure. Usually the opener or safety captain is the one who does it.?

Standard #: 8VAC20-780-340-A
Description: Based on staff interview and a review of video footage, when staff were supervising children, they did not always ensure their care, protection, and guidance.

1. On 9/2/2022, the Two?s classroom was outside during their morning playground time. At approximately 10:31am, video footage showed Child A (2 years old) push the unlocked gate in the back corner of the playground, exit through the gate, and the gate then closing behind Child A.
2. Staff B and Staff C were supervising the children in Two?s classroom while outside on the playground and they did not see Child A exit the playground.
3. The gate that Child A exited out of lead to the parking lot of the facility. Over an approximate 3 minute span, Child A walked to the outside of the parking lot, approximately 12 feet from the playground gate. A bicyclist who was passing by observed that Child A was unsupervised and yelled to Staff A (who was holding the front door of the facility open at that time) ?There is a child in the road!? At approximately 10:34am, video footage showed Staff A running towards Clara Barton Drive to retrieve Child A.
4. Staff A stated that Child A was found ?by the grassy area in between the sidewalk and the road (Clara Barton Drive).
5. Clara Barton Drive runs adjacent to Ox Road, which is a busy, 4 lane divided highway.
6. Staff B and Staff C had realized that Child A was missing when they conducted their head count prior to going back inside to the Two?s classroom. After checking the playground thoroughly for Child A, they went inside to the Two?s classroom to use their walkie talkie to contact the front office and notify them of a ?missing child.?
7. Shortly after they contacted the front office about the ?missing child?, Staff A walked back into the building with Child A and returned Child A to the Two?s classroom.

Description: Based on staff interview and a review of video footage, children under 10 years of age were not always within actual sight and sound supervision of staff.

Evidence:

1. On 9/2/2022, video footage showed that at approximately 10:31am, Child A (2 years old), exited the playground and walked approximately 12 feet to Clara Barton Drive until Staff A retrieved Child A at approximately 10:34am.
2. Child A was without sight and sound supervision of staff for approximately 3 minutes.
