Comments:
A complaint investigation was begun on 12/5/2022 in response to a complaint received on 11/18/2022. The investigation was continued on 12/15/2022 and 12/20/2022. The investigation included interviews, observation and a review of documentation. The complainant alleged an unsupervised child outside of the facility. Evidence revealed the complaint to be valid.

Description: Based upon review of records and staff interview, the facility has not ensured that for each group of children, a written record of daily attendance that documents the arrival and departure of each child as it occurs is maintained.
Evidence:
1. On 12/6/2022, an attendance record for 11/17/2022 was requested from staff 1. Staff 1 was unable to provide an attendance record for that date.
2. Staff 1 stated that parents are required to sign the children in and out and that the parents do not always fill in the record.
3. On 12/20/2022, Staff 2 provided an attendance record for 11/17/2022, however child 1 was not entered on the list.

Description: Based upon interviews, the facility has not ensured that when staff are supervising children, they always ensure their care, protection and safety.
Evidence:
On 11/17/2022, child 1, a nonverbal three year old male child with a parent documented developmental delay, was unsupervised in the street outside of the facility.
1. A witness reported that on 11/17/2022 at approximately 1:40 PM, traffic was stopped on King Street, as a child was "spinning" in the middle of the street, in front of Gifted Minds. The witness reported blowing the horn after which a woman came out of the facility and went after the child who was heading down the side street (Cumberland Ave) towards High Street (a four lane highway), one block away.
2. Staff 1 stated that she saw that the front door of the facility was ajar about 6 inches and heard a horn blowing out front. She went to the door and saw child 1 along the street. As she went to retrieve him, he began heading along Cumberland Ave beside the facility.
3. Staff 2 stated that she was in the classroom with child 1 before leaving the classroom to go to the nap room to get a child who was being picked up by family, leaving child 1 momentarily alone in the classroom. She stated that staff 1 was in the front office by the location of the facility front door when the child exited the building.

Description: Based upon interviews, the facility has not ensured that children under ten years of age are always within actual sight and sound supervision of staff.
Evidence:
1. According to staff 2, she was responsible for the supervision of child 1. Staff 2 stated that she left the classroom when she went to the nap room to get a child who was being picked up by her family, leaving child 1 out of sight and sound supervision in the classroom.
2. Child 1 exited the building. Staff 1 stated that she was unaware that the child had exited the building until she heard a horn blowing in the street. Child 1 was out of sight and sound supervision when he was outside of the facility.
