Technical Assistance:
Licensing inspector and director discussed mandated reporting and the facility's policy.

Comments:
A joint investigation was initiated on December 15, 2022 from 2:07 p.m. to 3:52 p.m. and concluded on January 20, 2023 with the local agency to investigate a complaint regarding behavioral guidance, supervision, and care, protection, and guidance. Interviews were conducted, staff records, children's records, and documentation were reviewed. An exit meeting was conducted on January 24, 2023. The complaint regarding behavioral guidance, supervision, and care, protection, and guidance were determined to be valid.

Description: Based on interviews, the center failed to ensure the care, protection, and guidance of all children enrolled in the program. Evidence: On December 14, 2022, staff 1 put Child A, 3 years old, outside on facility?s fenced in playground during inclement weather, approximately 35 degrees, without a coat or jacket.

Description: Based on interviews, the center failed to ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: Staff 1 admitted that on December 14, 2022, she did not always have the child within actual sight and sound supervision. Staff 1 stated that she did not have Child A, 3 years old, in sight when she was interacting with other children in the classroom. The child was not in sound of the staff as the classroom door that led the playground was closed while Child A was outside.

Plan of Correction: Retraining on specific procedures to follow while supervising all children; physical supervision, interaction with the child at all times, and request assistance from leadership when necessary.

Description: Based on interviews, the center failed to ensure that when time out is used as a behavioral guidance technique shall be in a safe, lighted, well-ventilated place, and within sight and sound of a staff member and the child shall not be left alone. Evidence: On December 14, 2022, child A, 3 years old, was placed in time out on the facility?s fenced in playground without a coat when the temperature was extremely low, approximately 35 degrees, the classroom door was closed and did not allow for the child to be within sound of the staff. The staff also did not have sight of the child for several minutes as she admittedly left the door to interact with other children in the class. Child A was left outside alone on the facility?s playground for an undetermined amount of time.

Plan of Correction: Retraining on Health and Safety procedures and policies while supervising children, classroom leadership, and positive phrasing.
