Comments:
An announced monitoring inspection was conducted on January 9, 2023, from 11:45 a.m. through 12:50 p.m. This inspection was initiated as a result of a self-reported incident from the center on December 5, 2022, with regards to the supervision of children. Video and documentation were reviewed as well as the interview of two staff. The records for one child and one staff were reviewed.

Standard #: 8VAC20-780-40-E
Description: REPEAT VIOLATION

Based on interview, review of documentation and of video recording, the licensee failed to ensure that the center?s activities, services and facilities are maintained in compliance with the policies and procedures that are required by these standards.

1. On December 5, 2022, Child A and Staff A were observed walking into the classroom from the playground for Child A to use the bathroom.
2. At approximately 4:10 p.m., Staff A was observed walking out of the classroom to go back onto the playground.
3. Child A was observed out of sight and sound supervision from approximately 4:10 p.m. to 4:11 p.m.
4. The center?s current policy, as of 8/31/2022, states ?No staff are EVER allowed to leave a child who is 12 and under in a classroom or playground by themselves.?
5. The director confirmed Staff A did not follow the center?s playground policy and procedures.

Plan of Correction: Starting December 6, 2022, teacher?s are no longer able to stand within a threshold while a child enters the building. When entering or exiting the building, crossing a threshold, teachers may only enter the building if they have taken the
amount of children that will put their co-teacher over their ratio. Staff A
was put on suspension and completed training starting December 6, 2022. December 7, 2022 all staff was retrained on sound and supervision policies and
licensing standards at the staff meeting.

Description: REPEAT VIOLATION

Based on review of video recording and staff interviews, the center failed to ensure one child, under the age of 10, was in actual sight and sound supervision of staff.
Evidence:
1. On December 5, 2022, at approximately 4:07 p.m., Child A, age 3, and Staff A were observed walking into the classroom for Child A to use the bathroom.
2. While Child A was in the bathroom, a parent was observed entering the classroom to pick up their child.
3. Staff A was observed standing at the doorway, in the classroom, that leads to the playground talking to the parent.
4. At approximately 4:09 p.m., the parent and Staff A were observed leaving the classroom. Staff A was observed walking outside to the playground and closed the classroom door.
5. Child A was observed coming out of the bathroom at approximately 4:10 p.m.
6. Staff B was observed walking into the classroom at approximately 4:11 p.m. and saw Child A standing by the door to the playground.
7. Child A was out of sight and sound supervision for approximately 1 minute.
8. Staff A and B confirmed Child A was out of sight and sound supervision.

December 7, 2022 all staff was retrained on sound and supervision policies and licensing standards at the staff meeting and all staff were informed that children must be within sight and sound at all times, there is no allotted time that children under
the age of 12 years should be out of sight and sound.
