Comments:
An unannounced investigation was initiated on 12/16/2022 and concluded on 12/27/2022 regarding a self-reported incident. Interviews were conducted and program policies and training was reviewed. After carefully interviewing all involved parties, violations were issued and can be viewed on the Violation Notice.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interview and a review of the center?s policies and procedures, the operational responsibilities of the licensee did not ensure that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
1. The center?s bottle-feeding policies include a verification process that requires a second staff person to verify that the bottle being served belongs to the appropriate child prior to a bottle being served.
2. Staff #1 confirmed that the bottle verification policy is not being practiced at the center.
3. The center?s bottle labeling policy states that ?each bottle must be assigned colored tape, as required for each child.?
4. Staff #1 confirmed that the center does not use assigned colored tape for each child?s bottle.
5. On 12/15/2022, Child #1 (12 months old) was served a bottle that did not belong to them by Staff #1 because the bottle verification policy and colored tape policy were not practiced.

Plan of Correction: We are doing regular checks that the bottle feeding/labeling procedures are being followed.

Standard #: 8VAC20-780-80-B-2
Description: Based on record review and interview, the center did not inform the department's representative as soon as practicable, but not to exceed two business days, of an injury to a child that occurred while the child was under the supervision of the center and required outside medical attention.
Evidence:
1. The guardians of Child #1 (12 months) stated that their child had been exposed to a food allergen on 11/10/2022 after picking up and drinking from another child?s bottle that had been dropped on the classroom floor.
2. An ?unusual event? document that was completed by Staff #2 on 11/11/2022 confirmed that Child #1 had consumed an allergen at the center, was administered an EpiPen on-site and taken to the emergency room in an ambulance.
3. The center did not notify the department?s representative of the incident that occurred 11/10/2022.

Plan of Correction: Moving forward, we will notify our dept. rep any time a child seeks medical attention because of an incident occurring in our care.

Standard #: 8VAC20-780-340-A
Description: Based on interview, when supervising children, staff did not always ensure care, protection, and guidance.
Evidence:
1. Staff #1 and Staff #2 confirmed that on 11/10/2022, Child #1 (12 months) located a dropped bottle on the classroom floor and drank from it, exposing the child to an allergen. The child was administered an EpiPen and taken to the hospital by ambulance.
2. Staff #1 and Staff #2 confirmed that on 12/15/2022, Child #1 was served approximately one ounce of formula from a bottle that belonged to a different child, exposing Child #1 to an allergen. Child #1 was administered three EpiPen's and was taken to the hospital by ambulance and was kept at the hospital overnight.

Plan of Correction: We have retrained staff on proper protocol for infants/toddlers with allergies to ensure that all safety procedures are being followed.

Standard #: 8VAC20-780-550-P
Description: Based on record review and interview, written records of a child?s serious injury did not contain all requirements.
Evidence:
1. An ?unusual incident report? was completed on 11/11/2022 and 12/16/2022 when Child #1 ingested an allergen on 11/10/2022 and 12/15/2022, respectively. The incident reports do not contain any future action to prevent recurrence of the injury or staff and parent signature or two staff signatures.
2. Staff #2 stated that they completed an ?unusual incident report? in place of their typical ?incident report? because it seemed repetitive.

Plan of Correction: Staff will continue to use the standard incidence/accident report moving forward rather than the unusual incident report.

Standard #: 8VAC20-780-560-P
Description: Based on interview, a child diagnosed with a food allergy was served a food identified on their written allergy care plan.
Evidence: Staff #1 and Staff #2 stated that on 12/15/2022, Child #1 (12 months) was served approximately one ounce of formula from a bottle that belonged to another child in the infant classroom. Child #1 has a diagnosed food allergy, and the center was provided with an allergy action plan for Child #1. Child #1 had a severe allergic reaction to the contents in the incorrect bottle that was served.

Plan of Correction: Staff members in all classrooms have been retrained on allergy protocols, bottle feeding/labeling procedures and we've reviewed all children's allergies in the building.
