Technical Assistance:
Today we discussed standard 8VAC20-780-550 related to the documentation of minor injuries.
If a mark is not observed by staff but is brought to the attention of the licensee by a parent, documentation should still be created indicating that the injury was not observed but was brought to the attention of staff or admin by the parent. Information that is known may be entered and if information is unknown or not available, that may be indicated accordingly in the documentation.

It is necessary that staff document even a minor injury with a red mark that "may" fade throughout the day.

Comments:
A focused monitoring inspection was initiated on 11/10/2022 and concluded on 2/8/2023 regarding a self reported incident received by the licensing inspector on 11/10/2022 regarding a minor injury. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. The inspection, which was conducted concurrently with the licensure renewal inspection started at 10:00 am and concluded at 12:30 pm.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-550-P
Description: Based on a review of documentation and interviews, the licensee did not always maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence.

Evidence:
The licensee self-reported to licensing that a parent was concerned that her toddler (child #1)Incurred marks on his face while in care.
The parent noticed two small oval red marks, one on each of the child's cheeks, when she arrived during nap time to take her child home.
The child's parent inquired about the marks with the two staff present in the classroom. However, these staff had just arrived in the classroom to relieve the morning staff whose shift ended and had not been informed of the marks or how they were incurred.
The parent then voiced her concern about the red marks on her child's cheeks with the program director who confirmed the presence of the marks but stated that she was not aware of how or when they appeared, and said she would speak to the morning staff to get more information.
The child's parent was not provided with any written report documenting the presence of the red marks on her child's cheeks on that day nor later. When the licensing inspector asked to view documentation of the minor injury which left marks on the child's cheeks, the program director was unable to demonstrate that a report had been written.

Plan of Correction: The licensee will review and retrain all staff in the requirement to properly document any and all minor or serious injuries - to include a mark a child's skin whether it seems like it might fade or not.
