An investigation was conducted in response to a self-reported incident of forbidden action which occurred on 2/7/2023. Interviews were conducted with staff and parent, staff record was reviewed. The Preschool 2 classroom, bathroom and playground were observed. During this investigation, staff reported another incident that occurred on 2/7/2023 with the same staff member regarding a child being left in the classroom unsupervised. The information gathered during this investigation for both incidents supports the allegations; violations were discussed with the center director. Standard #: 8VAC20-780-340-F Description: Based on staff and parent interviews, the center failed to ensure that all children under 10 years of age were within sight and sound supervision at all times.
Evidence: On Tuesday February 7, 2023 around 4:30 pm the Preschool 2 class went outside to the playground with Staff #1. Around 5:00 pm, a parent walked through the Preschool 2 class to the playground to pick up their child. The parent observed child #1, age 3 ? years standing by the window inside the classroom, looking out to the playground crying. There were no staff present in the classroom.
Staff #1 said sometime when they were outside she took child #1 into the class to use the bathroom, then went back outside.
Staff #2 who was also on the playground with her Preschool 1 class said she noticed child #1 on the playground but at some point child #1 was taken inside. The protocol is to stand at the outside door and watch the child in the bathroom.Plan of Correction: Staff will consistently have the children use the bathroom before going outside. If a child has to use the bathroom while outside a staff will take enough children inside to the bathroom to maintain ratios outside on the playground. The staff will remain with the children in the bathroom.
Standard #: 8VAC20-780-410-1 Description: Based on staff and parent interviews, a staff member engaged in a forbidden action by roughly handling a child and striking a child repeatedly.
Evidence: Staff #1 took the Preschool 2 children outside around 4:30 pm on February 7, 2023. While lining the children up against the building to go inside., staff # 1 said child # 2, 4 years old was not listening, hiding in the playground tunnel. Staff #1 said, "I grabbed the child (child #2) very forcefully from the tunnel, hitting the child on the bottom".
Staff #1 said, ?I was talking to the child (child #2) meanly and was yelling, then I saw a parent standing at the classroom door watching".
The parent said she arrived to the school at 4:50pm and observed the children on the playground. She watched for a couple minutes from her car, then heard staff call the children to line up. She walked into the classroom, and seeing a child unattended in the classroom, the parent quickly went to the door leading outside to get a teacher. The parent said "I saw a staff (staff #1) hitting a child (child #2) with an open fist on the shoulder and elbow, I screamed, the staff then grabbed the child by the arm and ripped the child off the play structure". The child was crying.
Staff #2 said she took her Preschool 1 class outside around 4:30 pm with the Preschool 2 class. Staff #2 said there were about 12 children on the playground between the 2 classrooms. Staff #2 said around 4:45 they were lining up to go inside, child #2 was not listening, hiding in the tunnel of the jungle gym. She observed staff #1 grab child #2 out of the tunnel and repeatedly spanking her lower back area. Child #2 was screaming and crying. A parent was at the door coming outside when she witnessed the incident and ran to get management.Plan of Correction: Staff #1 was immediately terminated. All staff will be reminded and trained about proper redirection and classroom management.
