Technical Assistance:
Today we discussed food allergies versus food preferences or food sensitivities.
If it is documented that a child has a food "allergy" then the child's record must contain an allergy plan, completed and signed by the child's physician. If a food is NOT an allergen, then please discuss and have the parent change and initial the paperwork and indicate that they merely prefer the child not eat the specified food or that the child has a sensitivity to a specified food and it is preferred that they do not eat that food. This is an important distinction and should be handled accordingly.

In addition, please be sure that the violation notice from your most recent licensing inspection is posted in a location visible to the public and easily reviewed. If there are several pages to the report, the pages should be loose to allow the pages to be turned without having to remove them from the sleeve or the board. The violation notice must be the top page of the posted inspection. In addition, as a reminder, the Supplemental page of the inspection report should never be posted because it may contain personal identifying or other confidential information.

Comments:
A monitoring inspection was initiated on and concluded on 2/16/2023. There were 28 children, ages 4 to 12 years old, present with 3 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 2 staff records were reviewed. The inspection started at 3:20 pm and concluded at 4:40 pm.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-60-A-8
Description: Based on a review of records, the licensee did not ensure that each child with a diagnosed food allergy has a written care plan to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.

Evidence:
Five children's records were reviewed.
The record for child #4 contained documentation that child #4 had a diagnosed food allergy.
Child #4's record did not contain a written care plan from his physician.

Plan of Correction: The program director states that she will contact the parent to request that a written care plan, signed by child #4's doctor, which must be submitted within 10 days from the inspection.
