Technical Assistance:
Technical Assistance given and Licensing Standards reviewed regarding lighting while children nap.

Comments:
An unannounced monitoring inspection was conducted on February 8, 2023, from 12:45pm to approximately 3pm. There were 24 children and 7 staff members present. The Inspector reviewed five children?s records and five staff records. The Inspector observed the interaction of staff and children throughout the inspection. Children were observed during naptime, transition from nap to restroom breaks, and diapering. First aid kits and emergency preparedness documents and supplies were observed. Medications were observed. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and interview, it was determined that the center failed to acknowledge that the background checks in the staff record show a disqualifying background which lists a barrier conviction, other felony conviction in the past 5 years, or knowledge of barrier for Virginia or elsewhere.
Evidence:
1. Staff #2 (date of hire 11/07/2022) completed the background check for the State of Virginia and the documentation dated October 31, 2022, disqualifies the staff member to work in a daycare setting stating, ?Not Eligible.?
2. Staff #1 failed to acknowledge that the background check for Staff #2 dated October 31, 2022, disqualified them as the document states, ?Not Eligible.?
3. Staff #1 confirmed that the Sworn Statement signed by Staff #2 on November 7, 2022, has it listed that they have been convicted of or are subject of pending criminal charges.
4. Staff #1, was unaware of the disqualifying criminal history check for Staff #2 and did not ensure that the information required prior to hire was correct.

Plan of Correction: The center responded with the following: The ineligible staff member was terminated immediately after completion of the licensing inspection.
All current staff members' files have been reviewed to ensure that all background checks are cleared for employment, and all files are in compliance. This has been done to ensure that this mishap was the only occurrence.
Moving forward, prior to onboarding any new hires, we will implement a dual-manager check effective immediately. This check will include two managers checking Fieldprint results, as well as sworn disclosure statements, prior to offering a position to the potential candidate.

Standard #: 8VAC20-780-60-A-8
Description: Based on record review and interview, it was determined that the center did not ensure that at the center a separate record for each child enrolled shall contain a written care plan for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction
Evidence:
1. Child #1 is diagnosed by a physician with a milk allergy which is documented in the physical and child?s record. There is no information in the record identifying actions to take in an emergency situation for this allergy.
2. Staff #1 confirmed that Child #1 does have a diagnosed milk allergy and that there is no information in record that identifies actions to take in an emergency situation.

Plan of Correction: The center responded with the following: The allergy plan was immediately requested from the parent and we will make sure that we receive the document within 30 days. Moving forward, we will ensure that all enrolled children with diagnosed allergies have an allergy plan on site.
