63.2 Child Abuse & Neglect

Technical Assistance:
Discussion on child observations at arrival, throughout the day and before departure.
Discussion on staff meetings to review of standards and policy and procedures frequently reviewed with staff.

Comments:
A complaint investigation was conducted on November 10, 2022 with other local agencies and ended on February 23, 2023 regarding an infant sustained bruising on the head which resulted in life threatening injuries.

Interviews were conducted, and documentation and pictures were reviewed. There was a preponderance of evidence to support the allegation regarding care and protection and operational responsibilities.

The complaint related violations are identified in the Violation Notice. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-140-A
Complaint related: No
Description: Based on children records review, the center did not obtain a physical examination by or
under the direction of a physician.
Evidence:
1. Child #2 (date of enrollment 9/06/2022) and Child #3 (date of enrollment 10/04/2022) did
not have physical examination in record available for review during the inspection.

Plan of Correction: School is now ensuring that no children are allowed to enroll without all required documents.

Complaint related: No
Description: Based on staff interviews and documents, the staff did not follow the operational responsibilities of the licensee by ensuring that the center's activities, services, and facilities
are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
1. Staff #1 and Staff #2 did not follow center's policy informing the Director or Assistant Director on all head injuries.
2. Staff #1 and Staff #2 did not follow center's policy for parental notification of injury. The
policy states any time there is a serious accident or injury at the center, the parents will
be notified immediately.
3. Staff #2 did not follow center's policy staff are encourage to discuss any suspicion of child
abuse and neglect with the Director or Assistant Director prior to speaking with others.
4. The center was not in compliance with all safe sleep practices recommended by the
American Academy of Pediatrics. An infant was observed sleeping in an infant crib with a
blanket.

Plan of Correction: Staff #1 was suspended immediately pending the investigation and then terminated. Staff #2 was retrained on safety protocol with an emphasis on notification of any signs of injury.

Description: Based on children records review, the center did not maintain and keep at the center a separate record for each child enrolled documentation of viewing proof of the child's
identity and age.
Evidence:
1. Child #1 did not have proof of identity and age available for review during the inspection.

Plan of Correction: School is now ensuring that no children are allowed to enroll without all required documents.

Complaint related: No
Description: Based on staff interviews and documentation, the staff supervising children did not ensure
their care, protection, and guidance.
1. On November 7, 2022, in the classroom of infant children (infant A) two staff had provided
care for a group of three children.
2. Child #1 arrived around 6:59 am and was in the care of Staff #1.
3. Staff #2 covered classroom during Staff #1's bus run from 2:05 pm to 3:15 pm.
4. All three children were asleep in cribs during this transition.
5. When Child #1 woke up from nap. Staff #2 changed child's diaper and observed bruising
on child's right side of the head.
6. When Staff #1 returned back to the classroom around 3:15 pm, Staff #2 asked Staff #1 about the child's bruising on the head. Staff #1 stated did not observe bruising on the
child's head while in their care.
7. Staff #2 left the classroom and returned to assigned classroom. Staff #1 continued with
caring for the children in the classroom.
8 Staff #1 and #2 did not report the concerns of the child's bruising on the head to Administrator when noticed.
9. Parent arrived to pick up child around 3:50 pm and noticed child's bruising and questioned
Administrator about what occurred. Parent did not receive an explanation as to how the child
obtain the bruising on the head while in care at the child care center.
10. Child #1 was taken by parent for medical care and child had substantially life-threatening
injuries.

Plan of Correction: Staff #1 was suspended immediately pending the investigation and then terminated. Staff #2 was retrained on safety protocol with an emphasis on notification of any signs of injury.
