Comments:
A complaint investigation was initiated on 2/14/2023 at 10:00am to 1:00pm. The complaint consisted of allegations received by the Licensing Office regarding behavioral guidance and injury reporting regulations. The physical plant, attendance, 2 staff records, and 1 child record were reviewed. Children were observed participating in free play. Based on staff interviews, observation and review of attendance for the classrooms, the preponderance of evidence does support the allegation. Therefore, the complaint is determined to be valid. Two violations were found related to the complaints of behavioral guidance and reporting of injuries and another violation was cited during the course of the investigation not directly related to the complaint.

Description: Based on review of 2 staff records, the center did not obtain the results of a criminal history record check and a central registry check from all states in which staff members have resided within the last five years prior to employment.

Evidence:
1)The record for Staff #2 (date of hire 11/15/22) did not contain documentation of a completed criminal history record check from all states where they resided within the last five years prior to employment.
2)The record for Staff #2 (date of hire 11/15/22) did not contain documentation of a completed central registry record check from all states where they resided within the last five years prior to employment.

Plan of Correction: Ensure that results of a criminal history check and central registry record check is obtained for every state where staff has resided in the last 5 years.

Complaint related: Yes
Description: Based on staff interviews and documentation review, staff did not use behavioral guidance that was constructive in nature, age and stage appropriate, or intended to redirect a child to appropriate behavior and resolve conflicts.

Evidence:
1)On 2/8/23, at approximately 9:30am, Child #1 (age 2) was playing roughly in the classroom with another child. They were climbing on shelves that were approximately 2 feet high from the floor, flipping over the shelves, and sliding across the tops of shelves. Staff #1, Staff #4 and Staff #6 all stated they were in the room at the time of the incident. The staff interviewed stated that this behavior went on for 20-30 minutes with no change in the children?s behavior.
2)Though staff asked the children to stop the inappropriate behaviors, staff did not redirect the children to appropriate behavior and the children continued to engage in flipping and sliding on shelves even after Child #1 flipped over a shelf and landed on the floor leaving a bruise under their right eye that developed throughout the day.

Plan of Correction: Ensure that staff uses behavioral guidance that was constructive in nature, age and stage appropriate or intended to redirect a child to appropriate behavior and resolve conflicts.

Complaint related: Yes
Description: Based on staff and parent interviews, the center did not notify the parent by the end of the day of any known minor injuries.

Evidence:
1)When a parent picked up their child (Child #1) at the center on 2/8/23 at approximately 4:30pm, they noticed a bruise under the child?s right eye. The parent took a photo of the child?s eye that day, spoke to staff and showed the staff the child?s injury.
2) The parent stated they spoke to Staff #3, Staff #5 and 2 other staff they couldn?t identify about the injury on the day of the incident. The staff told the parent that they weren?t sure how Child #1 sustained the injury.
3)An observation report was written by Staff #6 on 2/9/23 about the incident that occurred, but the incident was not communicated to the parent and the report was not signed by the parent.
4)On 2/14/23, during interviews with staff, multiple staff members recounted an incident on 2/8/23, at approximately 9:30am, where Child #1 (age 2) was playing roughly in the classroom with another child. They were climbing on shelves that were approximately 2 feet high from the floor, flipping over the shelves, and sliding across the tops of shelves.
5)Staff stated in interviews that the child had fallen from the shelves and may have been injured at that time, but they did not share that information with the parent. Staff stated that they thought either management or another staff member was going to write an injury report.
6)No report of the injury was made to the parent on 2/8/23 and the parent had not received notification of the center?s findings at the time of the investigation on 2/14/23.

Plan of Correction: Ensure that the center notifies parents by the end of day of any known minor injuries.
